Article 10 EC, in conjunction with the Conditions of Employment of Other Servants of the European Communities established by Regulation (EEC, Euratom, ECSC) No 259/68 of the Council of 29 February 1968 laying down the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities and instituting special measures temporarily applicable to officials of the Commission, as amended by Council Regulation (EC, Euratom) No 723/2004 of 22 March 2004, precludes legislation of a Member State, such as that at issue in the main proceedings, which is interpreted as meaning that, in relation to eligibility for unemployment benefit, periods of work completed as a member of the contract staff in an institution of the European Union established in that Member State are not taken into account and days of unemployment which have given rise to payment of an unemployment allowance pursuant to the Conditions of Employment of Other Servants of the European Communities are not treated as working days although days of unemployment for which benefit has been paid under the legislation of that Member State are so treated.

La présente convention ne préjuge pas l'application par les États membres de la Communauté européenne du règlement (CE) no 44/2001 du Conseil concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, et de toute modification apportée à celui-ci, de la convention concernant la compétence judiciaire et l'exécution des décisions en matière civile et commerciale, signée à Bruxelles le 27 septembre 1968, et du protocole concernant l'interprétation de cette convention par la Cour de justice des Communautés européennes, signé à Luxembourg le 3 juin 1971, tels qu'ils ont été modifiés par les conventions d'adhésion à ladite convention et audit protocole par les États adhérant aux Communautés européennes, ainsi que de l'accord entre la Communauté européenne et le Royaume de Danemark sur la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale, signé à Bruxelles le 19 octobre 2005.

This Convention shall not prejudice the application by the Member States of the European Community of the Council Regulation (EC) No 44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, as well as any amendments thereof, of the Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters, signed at Brussels on 27 September 1968, and of the Protocol on interpretation of that Convention by the Court of Justice of the European Communities, signed at Luxembourg on 3 June 1971, as amended by the Conventions of Accession to the said Convention and the said Protocol by the States acceding to the European Communities, as well as of the Agreement between the European Community and the Kingdom of Denmark on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, signed at Brussels on 19 October 2005.

To facilitate such collaboration as much as possible, each executive agency should be located at the place where the Commission and its departments are located in accordance with the Protocol on the location of the seats of the institutions and of certain bodies and departments of the European Communities and of Europol annexed to the Treaty on European Union and to the Treaties establishing the European Community, the European Coal and Steel Community and the European Atomic Energy Community.
