(11) In order to ensure that an agreement envisaged by a Member State does not render Community law ineffective and does not undermine the proper functioning of the system established by its rules, as well as to ensure that it does not undermine the Community's external relations policy as decided by the Community, the Member State concerned should be required to notify the Commission of its intentions with a view to obtaining an authorisation to open or continue formal negotiations on an agreement as well as to conclude an agreement.

Points out that a lack of reform and over-extensive control by the state in Turkmenistan have generated a foreign policy which isolates the country from the community of democratic, free-market-economy states which respect human rights; notes that Turkmenistan's economy is not based on free-market mechanisms and that there is little private entrepreneurship and, furthermore, that there is an alarming amount of state intervention in the economy;

(9a) As a means of evening out the differences in abatement cost faced by different Member States by allowing for increased geographical flexibility and, at the same time, enhancing the overall cost-efficiency of the total commitment of the Community, Member States should be able to transfer part of their allowed greenhouse gas emissions entitlement to another Member State.

(8a) As a means of evening out the differences in emission reduction costs faced by various Member States, and to allow for increased geographical flexibility, while at the same time enhancing the overall cost-efficiency of the total commitment of the Community, a Member State should be allowed to transfer a part of its greenhouse gas emissions entitlement to another Member State.

The Commission is in favour of seeking a solution at regional level and is prepared to back any action taken towards that end, whether in the form of conferences to be proposed at this time by officials in Niger and Mali or support for regional organisations, such as the Economic Community of the States of West Africa (ECOWAS) and the Community of Sahel-Saharan States (CEN-SAD).

Where radioactive waste or spent fuel is to enter the Community from a third country and the country of destination is not a Member State, the natural or legal person who has the responsibility for managing the shipment within the Member State through whose customs post radioactive waste or spent fuel is first to enter the Community (first Member State of transit) shall submit an application for authorisation to the competent authorities of that Member State.
