A provision has been included in the Agreement stating that Saint Kitts and Nevis may suspend or terminate the Agreement only in respect of all the Member States of the European Community and, reciprocally, the Community may also suspend or terminate the Agreement only in respect of all of its Member States.

On 16 December 2007, the Commission for the European Community and 15 CARIFORUM States (Antigua and Barbuda, Bahamas, Barbados, Belize, Dominica, the Dominican Republic, Grenada, Guyana, Haiti, Jamaica, Saint Kitts and Nevis, Saint Lucia, Saint Vincent and the Grenadines, Suriname and Trinidad and Tobago) initialled the agreement, which was signed by the EU and 13 CARIFORUM States on 15 October 2008, and by Guyana on 20 October 2008.

(55) considérant que, depuis l'entrée en vigueur de l'accord intérimaire de commerce et d'union douanière entre la Communauté et Saint-Marin(18), le territoire de cet État ne fait plus partie du territoire douanier de la Communauté; qu'il ressort des articles 1er, 5 et 7 de cet accord que les produits agricoles sont au même niveau de prix à l'intérieur de l'union douanière et que, par conséquent, il n'y a aucune raison économique pour octroyer des restitutions à l'exportation pour les produits agricoles communautaires expédiés vers Saint-Marin;
(55) Whereas since the entry into force of the Interim Agreement on trade and customs union between the Community and San Marino(18) the territory of that State no longer forms part of the customs territory of the Community; whereas it follows from Articles 1, 5 and 7 of that Agreement that prices for agricultural products are at the same level within the customs union and that there is, therefore, no economic justification for granting export refunds on Community agricultural products consigned to San Marino;

(8) considérant que, compte tenu des liens économiques étroits qui existent entre la République de Saint-Marin et la Communauté, il convient qu'elles concluent un accord concernant les billets et les pièces, l'accès aux systèmes de paiement et le statut juridique de l'euro dans la République de Saint-Marin; que, eu égard aux liens historiques existant entre l'Italie et la République de Saint-Marin, il convient que l'Italie négocie et puisse conclure le nouvel accord au nom de la Communauté;
(8) Whereas given the close economic relations between the Republic of San Marino and the Community, it is appropriate that an agreement concerning banknotes and coins, the access to payment systems and the legal status of the euro in the Republic of San Marino is concluded between the Community and the Republic of San Marino; whereas given the historical links between Italy and the Republic of San Marino, it is appropriate that Italy negotiates and may conclude the new agreement on behalf of the Community;

(2) considérant que l'accord intérimaire de commerce et d'union douanière entre la Communauté économique européenne et la république de Saint-Marin (5), du 27 novembre 1992, définit les territoires dans lesquels cet accord s'applique; qu'il est, dès lors, exclu que le territoire de Saint-Marin soit considéré comme faisant partie du territoire douanier de la Communauté;
(2) Whereas the Interim Agreement on trade and customs union between the European Economic Community and the Republic of San Marino of 27 November 1992 (5) defines the territories to which that Agreement applies; whereas the territory of San Marino cannot therefore be considered part of the Community's customs territory;

considérant que, conformément aux dispositions précitées, la république de Saint-Marin reprend et applique, avec l'entrée en vigueur de l'accord, la réglementation communautaire en matière vétérinaire dans la mesure nécessaire au bon fonctionnement de l'accord; qu'il y a lieu de préciser dans ce contexte quelles sont les dispositions effectivement nécessaires, ainsi que, le cas échant, leurs modalités d'adaptation pour la république de Saint-Marin; que les dispositions en question sont celles qui figurent dans la version en vigueur à tout moment dans la Communauté; qu'elles doivent être appliquées par la république de Saint-Marin à l'égard des États membres de la Communauté et pour les importations, dans ce pays, d'animaux et de produits en provenance des pays tiers,
Whereas, in accordance with the abovementioned provisions, at the time of entry into force of the Agreement with regard to trade and the customs union, the Republic of San Marino is to take over and apply the Community veterinary regulations where necessary for the proper functioning of the Agreement; whereas, in this context, it is necessary to specify which provisions are actually necessary and, where appropriate, the detailed rules for the application thereof in the Republic of San Marino; whereas the measures in question are those currently in force at any time in the Community; whereas such measures are to be applied by the Republic of San Marino with respect to the Member States of the Community and imports of animals and products from third countries into San Marino,

Whereas procedures must be adopted for making available to the San Marino Exchequer import duties collected on goods by the Community on behalf of the Republic of San Marino and also the percentage to be deducted by the Community to cover administration costs in accordance with the relevant rules in force in the Community;
