(9) It is desirable to lay down clear and reasonable guidance as to the factors that may be relevant for the determination of whether the unfair or discriminatory practices have caused material financial damage or are threatening to cause such damage; since it is often difficult to be exact in substantiating such financial damage, a reasonable prima facie case must be presented; in demonstrating such financial damage, attention should be given to the effects of possible other factors that could have an influence on this damage and in particular the prevailing market conditions in the Community;

Apres avoir examine cette plainte dans le delai de 60 joursqui lui etait imparti, sur la base des criteres prevus par le nouvel instrument commercial de la Communaute (presomption raisonnable de l'existence d'une pratique illicite imputable a un pays tiers d'un prejudice ou d'une menace de prejudice a une industrie communautaire) la Commission decide d'ouvrir une procedure d'examen qui s'etendra sur une periode maximale de5 a 7 mois.
After considering the request within the stipulated period of 60 days, on the basis of the criteria laid down by the Community's new commercial instrument (reasonable presumption of the existence of an unfair practice on the part of a non- member country that is causing or threatening to cause injury to a Community industry), the Commission decided to initiate an investigation which will cover a period of up to five to seven months.
