Exception faite des régimes d'aides destinés à remédier aux dommages causés par certaines calamités naturelles, il convient d'exclure les aides octroyées aux entreprises en difficulté du champ d'application du présent règlement, étant donné que ces aides doivent être appréciées à la lumière des lignes directrices communautaires concernant les aides d'État au sauvetage et à la restructuration d'entreprises en difficulté du 1er octobre 2004 (7), prolongées par la communication de la Commission concernant la prorogation de l'application des lignes directrices communautaires concernant les aides d'État au sauvetage et à la restructuration d'entreprises en difficulté du 1er octobre 2004 (8) ou des lignes directrices qui y succéderont, et ce afin d'éviter que ces dernières ne soient contournées.
Aid granted to undertakings in difficulty should be excluded from the scope of this Regulation, since such aid should be assessed under the Community guidelines on State aid for rescuing and restructuring firms in difficulty of 1 October 2004 (7) as prolonged by Commission communication concerning the prolongation of the application of the Community guidelines on State aid for rescuing and restructuring firms in difficulty of 1 October 2004 (8) or their successor Guidelines, in order to avoid their circumvention, with the exception of aid schemes to make good the damage caused by certain natural disasters.

(17) Le présent règlement ne doit pas exempter le cumul d'aides avec d'autres aides d'État, qu'elles soient accordées par des autorités nationales, régionales ou locales, ou avec un financement communautaire, concernant les mêmes coûts admissibles, si ce cumul entraîne un dépassement des seuils prévus par le présent règlement.
(17) This Regulation should not exempt aid cumulated with other State aid, including aid granted by national, regional and local authorities, or with Community assistance, in relation to the same eligible costs when such cumulation exceeds the thresholds fixed in this Regulation.

1. Without prejudice to Articles 3, 4 and 5, Member States shall ensure that general rules are established for the use of personal protective equipment and/or rules covering cases and situations where the employer must provide the personal protective equipment, taking account of Community legislation on the free movement of such equipment.
