Pour sa part, la Commission conteste que le Tribunal soit tenu d’indiquer aux requérantes, avant l’expiration du délai prévu par le droit communautaire pour intenter un recours en annulation, que la première requête signée par deux avocats turcs ne respectait pas les exigences de forme prévues aux articles 19 et 21 du statut de la Cour de justice et fait valoir que le Tribunal n’était donc pas régulièrement saisi.
22 For its part, the Commission does not accept that the Court of First Instance was bound to inform the appellants, before expiry of the period laid down by Community law for the bringing of an action for annulment, that the first application signed by two Turkish lawyers did not comply with the formal requirements laid down in Articles 19 and 21 of the Statute of the Court of Justice and contends accordingly that the action had not properly been brought before the Court of First Instance.

2. Sauf disposition contraire, le présent règlement n'affecte pas le droit d'intenter sur la base du droit civil, administratif ou pénal d'un État membre ou sur la base de dispositions de droit communautaire, des actions ayant pour objet d'interdire l'usage d'une marque communautaire dans la mesure où le droit de cet État membre ou le droit communautaire peut être invoqué pour interdire l'usage d'une marque nationale.
2. This Regulation shall, unless otherwise provided for, not affect the right to bring proceedings under the civil, administrative or criminal law of a Member Sate or under provisions of Community law for the purpose of prohibiting the use of a Community trade mark to the extent that the use of a national trade mark may be prohibited under the law of that Member State or under Community law.

Toutefois, si un État membre a déjà mis en place un programme qui pourrait bénéficier de l’aide communautaire en vertu du présent article et qu’il a l’intention de l’étendre ou d’en accroître l’efficacité, notamment en ce qui concerne le groupe cible du programme, sa durée ou les produits éligibles, l’aide communautaire peut être accordée sous réserve que les limites visées au paragraphe 4, point b), soient respectées pour ce qui est de la proportion de l’aide communautaire par rapport à la contribution nationale totale.
However, if a Member State already has a scheme in place that would be eligible for Community aid under this Article and intends to extend it or make it more effective, including as regards the target group of the scheme, its duration or eligible products, Community aid may be granted provided that the limits of paragraph 4(b) are abided by as regards the proportion of Community aid to the total national contribution.

Conformément à l'intention exprimée par la Commission de regrouper et de rationaliser les instruments de financement communautaires, il convient que la présente décision établisse un programme unique et rationalisé prévoyant la poursuite et le développement des activités lancées sur la base de la décision 2000/750/CE du Conseil du 27 novembre 2000 établissant un programme d'action communautaire de lutte contre la discrimination (2001-2006) , de la décision 2001/51/CE du Conseil du 20 décembre 2000 établissant un programme d'action communautaire concernant la stratégie communautaire en matière d'égalité entre les femmes et les hommes (2001-2005) , de la décision no 50/2002/CE du Parlement européen et du Conseil du 7 décembre 2001 établissant un programme d'action communautaire pour encourager la coopération entre les États membres visant à lutter contre l'exclusion sociale, de la décision no 1145/2002/CE du Parlement européen et du Conseil du 10 juin 2002 relative aux mesures d'incitation communautaires dans le domaine de l'emploi et de la décision no 848/2004/CE du Parlement européen et du Conseil du 29 avril 2004 établissant un programme d'action communautaire pour la promotion des organisations actives au niveau européen dans le domaine de l'égalité entre les femmes et les hommes, ainsi que des activités menées au niveau communautaire dans le domaine des conditions de travail.
In line with the Commission's express intention of consolidating and rationalising Community funding instruments, this Decision should establish a single and streamlined programme providing for the continuation and development of the activities launched on the basis of Council Decision 2000/750/EC of 27 November 2000 establishing a Community action programme to combat discrimination (2001 to 2006) , Council Decision 2001/51/EC of 20 December 2000 establishing a Programme relating to the Community framework strategy on gender equality (2001-2005) and European Parliament and Council Decisions No 50/2002/EC of 7 December 2001 establishing a programme of Community action to encourage cooperation between Member States to combat social exclusion, No 1145/2002/EC of 10 June 2002 on Community incentive measures in the field of employment and No 848/2004/EC of 29 April 2004 establishing a Community action programme to promote organisations active at European level in the field of equality between men and women, as well as those activities undertaken at Community level in relation to working conditions.

Notification should also be possible where the undertakings concerned satisfy the Commission of their intention to enter into an agreement for a proposed concentration and demonstrate to the Commission that their plan for that proposed concentration is sufficiently concrete, for example on the basis of an agreement in principle, a memorandum of understanding, or a letter of intent signed by all undertakings concerned, or, in the case of a public bid, where they have publicly announced an intention to make such a bid, provided that the intended agreement or bid would result in a concentration with a Community dimension.

LE CONSEIL DES COMMUNAUTÉS EUROPÉENNES ET LES MINISTRES DE LA SANTÉ DES ÉTATS MEMBRES, RÉUNIS AU SEIN DU CONSEIL, vu les traités instituant les Communautés européennes, considérant leur approche commune en matière de lutte contre le SIDA, dégagée dès 1986 et développée depuis (1), demeurent préoccupés par la progression de l'épidémie de SIDA dans les États membres de la Communauté et par ses conséquences sociales, économiques, juridiques et éthiques; rappellent leurs conclusions du 16 mai 1989 (2) affirmant que la contamination par injection de drogue est une préoccupation majeure des responsables de la santé; soulignent les très grands efforts entrepris par tous les États membres dans les domaines de la recherche, du traitement et de la prévention ainsi que l'important effort de coordination de la recherche entrepris au niveau communautaire; constatent que, malgré les progrès encourageants réalisés dans la recherche, des vaccins et traitements efficaces ne seront pas largement disponibles avant plusieurs années; rappellent l'importance de la coopération internationale, notamment avec l'Organisation mondiale de la santé (OMS) et le Conseil de l'Europe; considèrent comme opportun de réaffirmer et de préciser, à l'intention de tous les citoyens européens, les principes qui doivent guider la prévention et la lutte contre le SIDA; rappellent en outre leurs conclusions du 15 mai 1987 (3) décidant l'élaboration d'un plan d'action et de coordination à retenir par les États membres et sur le plan communautaire; conviennent à cette fin de renforcer la coordination des actions nationales et communautaires et de promouvoir des activités d'intérêt commun.
THE COUNCIL OF THE EUROPEAN COMMUNITIES AND THE MINISTERS FOR HEALTH OF THE MEMBER STATES, MEETING WITHIN THE COUNCIL, Having regard to the Treaties establishing the European Communities, Having regard to their common approach to combating AIDS, worked out in 1986 and subsequently expanded (1), Remain concerned by the increase in the AIDS epidemic in the Member States of the Community and by its social, economic, legal and ethical consequences; Recall their conclusions of 16 May 1989 (2) affirming that contamination by drug injection is a major concern of the health authorities; Stress the very considerable efforts made by all Member States in the fields of research, treatment and prevention as well as the major endeavour to coordinate research at Community level; Note that, in spite of encouraging progress achieved in research, effective vaccines and treatment will not be widely available for several years; Reiterate the importance of international cooperation, in particular with the World Health Organization (WHO) and the Council of Europe; Consider it advisable to reaffirm and specify, for the attention of all European citizens, the principles which should guide them in preventing and combating AIDS; Draw attention also to their conclusions of 15 May 1987 (3) in which they decided to draw up an action and coordination plan for adoption by the Member States and at Community level; Therefore agree to step up the coordination of national and Community projects and promote activities of common interest.
