18. estime néanmoins que l'absence de clarté, de précision et de sécurité de la législation actuelle quant aux droits de propriété individuelle et la non application du droit communautaire de manière appropriée et cohérente sont les premières causes des nombreux problèmes qui se posent en matière d'urbanisation et que ceci se combinant à un certain laxisme dans les procédures judiciaires n'a pas seulement exacerbé le problème mais a également généré une forme endémique de corruption dont les citoyens de l'UE sont une nouvelle fois les premières victimes, mais a également entraîné des pertes significatives pour l'État espagnol;

Believes, nevertheless, that the absence of clarity, precision and certainty with regard to individual property rights contained in existing legislation, and the lack of any proper and consistent application of environmental law, are the root cause of many problems related to urbanisation and that this, combined with a certain laxity in the judicial process, has not only compounded the problem but has also generated an endemic form of corruption of which, once again, the EU citizen is the primary victim, but which has also caused the Spanish State to suffer significant loss;

The conclusions of that Committee will hopefully provide a blueprint for EU legislation which combines legal clarity and certainty with responsiveness to market developments as well as even-handed and rigorous enforcement.
