L’argument central de la Commission pour attaquer la décision-cadre était le suivant : la Commission européenne estimait qu’exiger des Etats membres qu’ils fassent usage de sanctions pénales en cas de violation du droit communautaire de l’environnement devait être fondé sur le droit et les procédures décisionnelles du Traité CE (ce qu’on appelle la « méthode communautaire »), et non sur le troisième pilier du Traité UE, ce qui avait été le choix du Conseil.
The central argument used by the Commission in taking this action against the Framework Decision was the following: the Commission claimed that requiring Member States to use criminal sanctions for violations of EC environment law has to be based on the law and decision-making procedures of the EC Treaty (the so-called “Community method”), and not on the “third pillar” of the EU Treaty, as had been the choice of the Council.
