Whereas the unilateral decision by the State Government of North Dakota to divert waters from Devils Lake into the Sheyenne River and eventually Lake Winnipeg contravenes the Boundary Waters Treaty between Canada and the United States of America; And whereas, such a contravention would set precedent for future negotiations under the said treaty; And whereas such negotiations should most properly be reviewed by the International Joint Commission; And whereas this review has not taken place; And whereas the Devils Lake Diversion project is scheduled to begin operations in July, 2005; And whereas the said water diversion may have serious and harmful ecological and economic repercussions in Canada; Be it resolved that the Standing Committee on the Environment & Sustainable Development urgently calls upon the Government of Canada to immediately exhaust any and all diplomatic and/or legal options available to prevent any water diversion from Devils Lake, North Dakota until the project has been reviewed by the International Joint Commission.

1b. By way of derogation from paragraph 1a, Member States that during at least one year in the period 2010-2013 allocated more than 10 % of their amount available for granting the direct payments provided for in Titles III, IV and V of this Regulation, with the exception of Section 6 of Chapter 1 of Title IV, to financing the measures laid down in Section 2 of Chapter 2 of Title III of this Regulation, the support provided for in subpoints (i) to (iv) of point (a) and in points (b) and (e) of Article 68(1) of this Regulation, or the measures under Chapter 1, with the exception of Section 6, of Title IV of this Regulation may decide to use more than 13 % of the annual national ceiling set out in Annex VIII of this Regulation subject to approval by the Commission".

5. Tout acte délégué adopté conformément à l’article 16 n’entre en vigueur que si le Parlement européen ou le Conseil n’a pas fait connaître son opposition dans un délai de deux mois à compter de la notification dudit acte au Parlement européen et au Conseil ou si, avant l’expiration dudit délai, le Parlement européen et le Conseil ont tous deux informé la Commission qu’ils ne comptaient pas faire opposition.
5. A delegated act adopted pursuant to Article 16 shall enter into force only if no objection has been expressed either by the European Parliament or the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object.

81. se déclare préoccupé par le fait que l'Érythrée, en dépit de graves violations des droits de l'homme, dont des détentions arbitraires et des tortures infligées à des milliers de détenus, ne figure pas dans le rapport annuel du Conseil sur les droits de l'homme en 2005; regrette que, malgré sa résolution du 18 novembre 2004 sur la situation des droits de l'homme en Érythrée , dans laquelle le Parlement condamne la situation des droits de l'homme en Érythrée et lance un appel au Conseil et à la Commission afin qu'ils engagent la procédure de consultation prévue à l'article 96 de l'accord de partenariat ACP-UE, le Conseil et la Commission n'entreprennent que peu de démarches à cet égard; invite dès lors le Conseil et la Commission à engager immédiatement la procédure de consultation prévue à l'article 96 dudit accord de partenariat, à propos de la situation des droits de l'homme en Érythrée, la procédure de consultation prévue à l'article 96 dudit accord de partenariat;
81. Expresses its concern at the fact that Eritrea, in spite of serious human rights violations, including arbitrary detentions and the torture of thousands of detainees, is not mentioned in the Council's Annual Report on human rights in 2005; regrets that, in spite of its resolution of 18 November 2004 on the human rights situation in Eritrea in which it condemned the human rights situation in Eritrea and called on the Council and the Commission to open the consultation procedure in accordance with Article 96 of the ACP-EU Partnership Agreement, little action has been taken by the Council and the Commission on this matter; calls on the Council and the Commission without delay to open the consultation procedure under Article 96 of the ACP-EU Agreement with regard to the human rights situation in Eritrea;

11. se félicite du protocole d'accord conclu le 10 juin 2005 entre la Commission et la Chine sur la limitation des exportations de textiles chinois; cependant, invite la Commission et le Conseil à étendre le champ d'application dudit accord aux autres catégories de textiles si nécessaire, ainsi qu'à garantir la transparence de la base servant au calcul des limitations en matière d'importations; insiste sur le recours aux clauses de sauvegarde en cas d'application incorrecte dudit accord;
11. Welcomes the ‘Memorandum of Understanding’ concluded between the European Commission and China on 10 June 2005, with regard to the limitation of Chinese textile exports; however, calls on the Commission and the Council to extend the coverage of the agreement to other categories of textiles where necessary and to ensure transparency as to the calculation basis used for the export limitations; insists that the safeguard clauses be applied in the event of an inappropriate application of the agreement;
