Acknowledges from the Institute that in 2012, the Commission's Internal Audit Service (IAS) carried out audit work in accordance with the Institute's strategic audit plan; notes that this work included an audit on budget execution, which identified good practices, but also led to four very important recommendations; takes note of the Institute's action plan to address the risks and notes that the IAS considered this to be adequate; notes that no critical recommendations were open as of 31 December 2012; expresses concern, however, that the implementation of two very important recommendations from 2011 has been delayed;

Acknowledges from the Agency that in 2012, the Commission's Internal Audit Service (IAS) carried out a risk assessment and a follow-up engagement in accordance with the Strategic Audit Plan of the Agency; notes that there were no open critical or very important recommendations stemming from the previous IAS audit reports; notes, however, that in the course of the risk analysis, the IAS identified certain processes of high inherent risk which could not be considered as auditable within the audit plan as the controls were assessed as absent or insufficient; notes that the Agency's management submitted an action plan aimed at addressing those weaknesses adequately;

Points out that, in accordance with Regulation (EC) No 1049/2001 and in order to guarantee full democratic and transparent parliamentary control, access should likewise be granted to documents produced when powers are delegated (delegated acts), since these make up a substantial portion of European legislation, for which reason adequate and transparent parliamentary and democratic control ought to be fully guaranteed; particularly deplores, in this context, the lack of transparency of the European supervisory authorities (EBA, EIOPA, ESMA) owing to lack of involvement on the part of the co-legislators; considers it disappointing that no single register of all second-level legislation has yet been established, and calls on the Commission to set one up without delay.

La Commission note que la décision 2010/405/UE ne prescrit aucune condition particulière de participation à la coopération renforcée dans le domaine de la loi applicable au divorce et à la séparation de corps et que la participation de la Lituanie devrait accroître les effets bénéfiques de cette coopération.

47. Takes note of the progress made in the area of migration and asylum; regrets, however, that Turkey has not, since December 2006, resumed the negotiations on a readmission agreement with the EC, the signing of which is a condition for a visa facilitation agreement; and calls on the Turkish government to intensify its cooperation with the EU on migration management, including through proper implementation of the existing bilateral readmission agreements and protocols with Member States; notes that no development can be reported on alignment with EU visa lists; calls on the Commission and the Turkish government to start negotiations on a visa facilitation agreement; urges the Member States to ease visa restrictions for bona fide travellers such as students, academics or businessmen; calls for full respect of the human rights of asylum-seekers and refugees, including open and unrestricted access to all detention centres by the UN High Commission for Refugees;

Notes that, in the light of the judgement of the Court of First Instance of 4 October 2006 in Case T-193/04 Tillack v Commission , which found that no breach of law had been committed regarding the action taken by OLAF, Parliament's proceedings on the outstanding Special Report of the Ombudsman referring to complaint 2485/2004/GG must be closed;
