When investigating the restructuring, the Commission gave third parties the possibility of commenting on how Alitalia had used the loan of EUR 400 million which it authorised Italy to guarantee on 20 July 2004 (see IP/04/965). In the light of these comments, the Commission carried out a full analysis of Alitalia’s behaviour, including an independent examination (see IP/05/57). It took the view that no misuse of this aid had taken place; and that, in particular, the company’s capacity complies with the commitments made and the new routes are profitable. The Commission also notes that the Italian authorities have undertaken to repay this loan in advance, as soon as the recapitalisation of AZ Fly has been concluded and in any event before 31 December 2005.

Notes that although the Commission has acknowledged the existence of wrongdoing in the so-called Blue Dragon affair and has decided to cut EU funds corresponding to the fraud, it considers it to be the sole responsibility of the Member State that shares the management of these funds to investigate the full extent of the alleged irregularity, to pursue its culprits, and/or to seek compensation for the victims of the fraud; notes also the fact that the Blue Dragon affair falls between two Member States, Spain and France, which makes the attribution of responsibility more difficult and which gives it a more obviously European character; considers that the Commission is a public authority with direct responsibilities concerning European citizens, on whose trust it depends - through the European Parliament - and that, therefore, the Commission should not only seek to recover European funds from a Member State where they have been misused, but should also use its best endeavours to see that wrongdoers are prosecuted and their victims compensated;

DRAFT COMMISSION DIRECTIVES ON - MOBILE AND PERSONAL COMMUNICATIONS - IMPLEMENTATION OF FULL COMPETITION IN TELECOMMUNICATIONS MARKETS The Council held a wide-ranging exchange of views on the above draft Directives based on Article 90(3) of the Treaty; it then adopted the following conclusions: "The COUNCIL - NOTES that the Commission requested, on 3 August 1995, any comments from the Council on the draft Commission Directive amending Directive 90/388/EEC as regards mobile and personal communications; sent the President-in-Office of the Council, on 29 September 1995, the draft Commission Directive amending Directive 90/388/EEC as regards the implementation of full competition in telecommunications markets; - NOTES also the public consultation launched by the Commission following the publication of the two draft Directives in the Official Journal of the European Communities; - REAFFIRMS that it is important that the conditions governing the definition of the Community's future policy on the liberalization of telecommunications services and infrastructures should result from a political agreement based on the compromise of December 1989 and takes note of the Commission's support for this approach; - RECALLS in this connection the political agreement reached at the Telecommunications Council meeting on 17 November 1994, which was given concrete form in the Council Resolution of 22 December 1994 and in the statements made on that occasion; RECALLS that this Resolution recognizes in particular the principle of liberalization of telecommunication infrastructures on 1 January 1998, on the understanding that an additional transitional period is granted to certain Member States; - POINTS OUT that the Commission must also take account in its approach of the responsibilities of the European Parliament and the Council for the legislative provisions designed, on the basis of Commission proposals, to establish the European regulatory framework for telecommunications, parti ...
