TRADUCTIONS EN CONTEXTE

Au regard de ce qui précède, et afin de conserver la dynamique enclenchée comme de développer l'expérience accumulée ces cinq dernières années, la Commission a l'intention de continuer à suivre de près l'évolution du marché européen du capital-investissement et de procéder, en 2004, à une nouvelle analyse des aspects de ce marché demeurant inefficaces. À cet effet, elle tiendra compte de l'invitation que lui avait adressée le Conseil européen de Bruxelles de mars 2003: «oeuvrer à la réduction des entraves à la création d'un véritable marché européen des capitaux à risque, à même de favoriser l'esprit d'entreprise, et à examiner entre autres les obstacles aux investissements réalisés par les investisseurs institutionnels (fonds de pension) sur les marchés de capital-risque» (point 31, deuxième tiret, des conclusions de la Présidence).
With these considerations in mind, in order to keep up the momentum, and building on the experience of the last five years, the Commission has the intention of continuing to closely follow developments in the European risk-capital market and carrying out further analysis in 2004 of aspects of the market where inefficiencies remain, taking into the March 2003 Brussels European Council invitation for the Commission : "to work towards reducing barriers to the creation of a genuine European risk capital market, capable of supporting entrepreneurship, and examine interalia obstacles for investments by institutional investors (pension funds) in venture capital markets" (point 31, second indent, of the Presidency conclusions.).

Le moyen principal concerne le fait que le Conseil a en réalité appliqué lui-même l'article 10, mais en violation des conditions institutionnelles requises; le Conseil aurait ainsi violé, d'une part, l'article 65 du statut et, d'autre part, les articles 3 et 10 de l'annexe XI. Par le moyen subsidiaire, la Commission expose que, en toute hypothèse, les conditions de fond pour l'application de l'article 10 n'étaient pas réunies en 2011, ainsi que cela ressortait d’ailleurs de deux rapports économiques qu'elle avait présentés au Conseil sur demande de celui-ci.
The primary plea in law concerns the fact that the Council has in fact itself applied Article 10, but in breach of the required institutional conditions; the Council has thereby infringed, first, Article 65 of the Staff Regulations and, second, Articles 3 and 10 of Annex XI. By the alternative plea in law, the Commission argues that, in any event, the substantive conditions for the application of Article 10 were not met in 2011, as is clear moreover from the two economic reports which the Commission submitted to the Council at the latter’s request.
