TRADUCTIONS EN CONTEXTE

L’arrêt du Tribunal est erroné en ce que: i) il contredit des décisions antérieures rendues sur la même question (T-332/06 et C-194/09 P); ii) en faisant application de l’article 107, paragraphe 1, TFUE, il confond deux critères, qui sont tous deux nécessaires pour qu’il y ait une aide, en faisant découler l’existence d’un avantage pour Alcoa de la simple constatation du caractère étatique des ressources qui ont été employées; iii) il est dépourvu d’une motivation appropriée dès lors qu’il n’a pas relevé que la Commission avait présumé à tort que la mesure procurait un avantage à Alcoa et n’avait donc pas effectué d’analyse économique appropriée pour apprécier, le cas échéant, la valeur de cet avantage.
The General Court erred in its judgment in so far as (i) it was inconsistent with previous judgments handed down on the same question (T-332/06 and C-194/09 P); (ii) when applying Article 107(1) TFEU, it confused two criteria, both necessary to prove the existence of aid, inferring that an advantage was conferred on Alcoa from the mere finding that the resources used were of State origin; (iii) it failed to provide an adequate statement of reasons in so far as it failed to observe that the Commission had erred in assuming that Alcoa had obtained an advantage from the measure and had not, therefore, to that end, carried out a proper economic analysis to calculate the extent of the advantage in this particular case.

By this appeal, the Commission seeks the annulment of the judgment of the Civil Service Tribunal (CST) of 13 November 2008 in Case F-90/07 Traore v Commission, in which the CST annulled the Commission's decision of 12 December 2006, rejecting Mr Traore's candidature for the post of head of operations of the Commission's delegation in Tanzania and the decision to appoint another candidate to that post, inasmuch as the level at which the post at issue was to be filled had been fixed at grades AD 9 to AD 14 (and not limited to one of the groups of two grades AD 9/AD 10, AD 11/AD 12 or AD 13/AD 14).

Dans un rapport sur le fonctionnement de la nouvelle organisation commune de marché dans le secteur du tabac brut instituée en 1992, qui avait été transmis à la commission du contrôle budgétaire le 5 octobre 1995, la Commission a rendu compte des progrès - ou, plus exactement, de l'absence de progrès - enregistrés à ce jour par l'Italie et la Grèce dans la mise en place de leurs agences de contrôle respectives, lesquelles auraient dû être instituées le 30 avril 1993 au plus tard: des complications administratives et - dans le cas de l'Italie -législatives, qui ont surtout mis en lumière une absence caractérisée de détermination politique de la part des autorités nationales concernées, expliquent que, quatre années après le délai fixé, les perspectives touchant la mise en place de ces agences apparaissent toujours aussi peu encourageantes.

In a report "on the functioning of the new Common Organisation of the Market in Tobacco established in 1992" transmitted to the Committee on Budgetary Control on 5 October 1995, the Commission described the progress - or, rather, the lack of it - made to that date by Italy and Greece in setting up the respective supervisory agencies, which ought to have been established by 30 April 1993: administrative and - in the case of Italy - legislative complications which rather point to a distinct lack of political will of the national authorities concerned to act, have made that four years after the fixed deadline the prospects of setting up the agencies remain bleak.
