Misinterpreted the first sentence of Article 2(5) of the Basic Anti-Dumping Regulation, first subparagraph, and thereby the corresponding provision of Article 2.2.1.1, first subparagraph of the Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 in Annex 1A to the Agreement Establishing the World Trade Organisation (‘ADA’);

34. considère que des actions individuelles qui, pour reprendre les termes de la décision du comité de l'OMC sur le commerce et l'environnement du 15 décembre 1993, touchent les relations entre mesures commerciales et mesures environnementales, à l'effet de promouvoir un développement durable (par exemple les ajustements fiscaux aux frontières et les droits anti-dumping écologique) ne sont susceptibles de s'avérer compatibles avec les règles et les régimes de l'OMC, eu égard à l'état actuel de la jurisprudence de l'OMC dans ce domaine, que si elles sont adoptées dans le cadre d'un accord mondial juridiquement contraignant sous l'égide de la CCNUCC, et demande par conséquent à la Commission de présenter au Parlement européen et au Conseil, avant la COP 17 en Afrique du Sud, une communication sur la manière de prévoir un tel système dans l'accord qui pourrait succéder au protocole de Kyoto;

Considers that individual actions which, in the words of the WTO’s Trade Negotiations Committee Decision on Trade and Environment of 15 December 1993, affect ‘the relationship between trade measures and environmental measures, in order to promote sustainable development’ (such as border tax adjustments and ‘anti-eco-dumping duties’) are only likely to prove to be compatible with WTO rules and disciplines, given the current state of WTO jurisprudence in this field, if they are taken under the auspices of a legally binding global agreement under the authority of the UNFCCC, and therefore calls on the Commission to submit before COP 17 in South Africa a communication to the European Parliament and the Council on how such a system could be provided for in any post-Kyoto agreement;

15. suite aux résultats de l'enquête anti-dumping menée dans le secteur de la chaussure, attestant d'interventions étatiques et de pratiques de dumping social par la Chine, et aux mesures prises par la Commission européenne pour corriger cette distorsion de concurrence, demande à l'UE de faire respecter par ses partenaires commerciaux, tels que la Chine, les règles loyales et équitables du commerce international; appelle la Commission, dans le cadre de sa réflexion prochaine sur l'usage des mesures anti-dumping, à simplifier les procédures visant à faciliter l'emploi de mécanismes anti-dumping par les PME, et réclame un accroissement de la transparence de la procédure anti-dumping;

In the light of the findings of the anti-dumping investigation in the footwear sector, which proved that China had been practising State intervention and social dumping, and of the steps taken by the Commission to correct this distortion of competition, urges the Union to make its trading partners, such as China, comply with fair and equitable international trade rules; calls on the Commission, when considering, as it is shortly due to do, how the anti-dumping measures should be used, to simplify the procedures so that anti-dumping mechanisms can be employed more readily by SMEs; furthermore, calls for the anti-dumping procedure to be made more transparent;
