Reiterates its support for a European initiative to ensure that the fundamental rights of persons deprived of their freedom are upheld and that persons who are imprisoned can be reintegrated into society upon their release; expresses concern at the disastrous level of prison overcrowding in many Member States, and at bad prison conditions and treatment of inmates, and calls for a European initiative to be launched to ensure that the recommendations of the European Committee for the Prevention of Torture and the judgments of the European Court of Human Rights are implemented, including by the police and in immigration centres and psychiatric hospitals; recommends that measures be taken to reduce prison overcrowding, such as avoiding excessive use of pre-trial detention, providing alternatives to custodial sentences, considering the decriminalisation of certain offences and/or shortening the periods for which people can be held without charge;

10. insiste pour que les activités extérieures de la BEI soient conformes aux objectifs généraux de l'Union, tels qu'énoncés dans le traité sur l'Union européenne et dans le traité sur le fonctionnement de l'Union européenne; est d'avis que la BEI, institution bancaire dont l'activité est guidée par les politiques de l'Union, devrait équilibrer ses opérations de financement entre les différentes régions situées dans le voisinage de l'Union; estime que dans les régions où les activités de la Banque risquent de faire double emploi avec celles d'autres institutions financières régionales ou internationales publiques, il serait bon de répartir clairement le travail entre les différents acteurs; se félicite à cet égard de l'accord établissant un Cadre d'investissement en faveur des Balkans occidentaux; réaffirme néanmoins que l'accord de coopération existant conclu entre la Commission, la BEI et la BERD concernant les opérations de financement dans les pays du voisinage oriental, en Russie et en Asie centrale devrait être révisé; se félicite donc que le comité des Sages souscrive aux recommandations, adoptées en mars 2009 par le Parlement européen, préconisant une meilleure compréhension mutuelle entre la BEI et la BERD.

Highlights the fact that the external action of the EIB should be in line with EU policy objectives as stipulated in the Treaty on the European Union and the Treaty on the functioning of the European Union; takes the view that the EIB, as an EU-policy-driven bank, should keep a balance in terms of lending between the different regions in the EU neighbourhood; considers that, as regards regions where EIB activity may overlap with other regional or international publicly funded financial institutions, a clear division of labour may be necessary; welcomes the Western Balkan Investment Framework in this respect; reiterates, however, that the current cooperation agreement between the Commission, the EIB and the EBRD as regards financing operations in the Eastern Neighbourhood, Russia and Central Asia needs to be revised; welcomes, therefore, the fact that the Steering Committee of ‘wise persons‘ agrees with the recommendations adopted in March 2009 by the European Parliament on a better mutual understanding between the EIB and the EBRD.

Le Comité réaffirme néanmoins sa position déjà exprimée dans son avis sur la proposition de règlement du Conseil modifiant le règlement (CE) n° 1258/99 relatif au financement de la PAC(11), selon laquelle, dans le cas particulier du FEOGA-Garantie, les recettes affectées doivent demeurer disponibles pour les interventions dans le cadre de ce Fonds exclusivement.
The Committee would, however, reaffirm what it said in its opinion on the proposal for a Council Regulation amending Regulation (EC) No. 1258/1999 on the financing of the CAP(11), namely that in the specific case of the EAGGF Guarantee Fund, earmarked revenue must be available only for applications coming under that Fund.

REGIME COMMUNAUTAIRE DES INTERVENTIONS DES ETATS MEMBRES EN FAVEUR DE L'INDUSTRIE HOUILLERE - LIGNES DIRECTRICES DU CONSEIL Vu la communication de la Commission demandant l'avis conforme du Conseil concernant son projet de décision relative au régime communautaire des interventions des Etats membres en faveur de l'industrie houillère ; vu la consultation du comité consultatif de la CECA en date du 2 avril 1993 ; vu la demande d'avis adressée au Parlement européen par le Conseil le 23 avril 1993, le Conseil réaffirme la nécessité d'une nouvelle décision relative aux interventions des Etats membres en faveur de l'industrie houillère de la Communauté pour la période restant à courir jusqu'à l'expiration du traité CECA en 2002 ; le Conseil, bien qu'il n'ait pas encore terminé son examen de la proposition et ne soit donc pas actuellement en mesure de donner un avis conforme à l'unanimité, souligne néanmoins l'importance des principes suivants : - la nécessité, compte tenu des prix du charbon sur les marchés internationaux, de faire de nouveaux progrès vers la viabilité économique de l'industrie houillère de la Communauté, qui sera réalisée grâce à la réduction des coûts de production et des capacités, en vue d'une diminution progressive des aides.
COMMUNITY RULES FOR STATE AID TO THE COAL INDUSTRY - COUNCIL GUIDELINES Having regard to the communication by the Commission requesting Council assent concerning its draft Decision establishing Community rules for State aid to the coal industry; Having regard to the consultation of the ECSC Consultative Committee dated 2 April 1993; Having regard to the request for an Opinion of the European Parliament forwarded to it by the Council on 23 April 1993, The Council reaffirms the need for a new state aid Decision for the Community's coal industry to cover the remaining period until the expiry of the ECSC Treaty in the year 2002; The Council, although it has not yet finished its examination of the proposal and therefore is not currently able to give its formal unanimous assent, nevertheless underlines the importance of the following principles: - the need to make further progress in the light of international market prices for coal towards economic viability of the Community's coal industry which will be attained through the reduction of production costs and capacities, in order to achieve degression of aids.
