Loin d'émettre l'idée que le législateur devrait faire preuve de la plus grande retenue, la Cour suprême du Canada l'invite, au contraire, à se montrer plus expansif et à s'exprimer comme au temps du développement de la common law, le Code criminel ayant en effet évolué à partir de celle-ci pour aboutir à sa codification.
Rather than the Supreme Court of Canada suggesting to parliamentarians that they should limit or contain themselves, the court says that parliamentarians should take an expansive role and do it, as we did in the common law, one at a time, as experience suggests — which is the way the Criminal Code evolved from the common law to the statutory.
