Following the decision taken on 27 May 2005 by the UN Working Group on the five Cuban citizens being held in the USA – Antonio Guerrero, Fernando González, Gerardo Hernández, Ramón Labañino and René González – stating that 'the trial did not take place in a climate of objectivity and impartiality', the 11th Circuit Court of Appeals of Atlanta (USA) unanimously decided on 9 August 2005 to annul the judgment delivered in Miami and therefore to quash the convictions against the five Cuban nationals, and ordered a new trial to be held.
