Cependant, la question de la propriété de biens culturels pillés pendant la deuxième guerre mondiale se trouve hors du champ d’application de ces deux instruments. Ceux-ci visent à concilier le principe fondamental de la libre circulation des biens culturels avec celui de la protection des trésors nationaux.
The ownership of cultural property looted during the Second World War is an issue that falls outside the scope of both of these instruments, however, since their aim is to reconcile the basic principle of the free circulation of cultural property with that of the protection of national treasures.

It recommends, for example, the implementation of a system of cooperation between the various administrations and institutions involved in preventing and combating the unlawful trafficking of cultural objects at European level, the creation of a European internet portal, the endorsement of the international conventions of UNESCO and UNIDROIT[11], the imposition of an obligation to provide information at Union level on internet sales sites, the standardisation of national documents authorising the dispatch of cultural objects, the creation of a "passport" for goods being moved within Europe or the introduction of a general obligation to keep police records of moveable cultural objects.

The study showed that the system of cultural heritage protection in each country consisted of a core of national treasures which could not permanently leave the national territory, a second category comprising cultural objects that required national authorisation in order to be transferred abroad and a third category consisting of all the objects which could move freely without controls because of their relative lack of importance in cultural terms.
