Que doit-on entendre par la notion de circonstances extraordinaires qui entourent l’évènement que sont les «défaillances imprévues pouvant affecter la sécurité du vol», mentionnées au considérant 14 précité et qui, selon le point 23 de l’arrêt Wallentin, précité, ne sauraient pas constituer elles-mêmes, en tant que défaillances imprévues pouvant affecter la sécurité du vol, des circonstances extraordinaires, mais sont, au vu du point 22, uniquement susceptibles d’en produire?
What should be understood by the concept of extraordinary circumstances which, according to paragraph 23 of the Wallentin judgment, surround the event ‘unexpected flight safety shortcomings’ as referred to in the aforesaid recital 14 if, in the light of paragraph 22, unexpected flight safety shortcomings cannot themselves constitute extraordinary circumstances but may only produce such circumstances?

Selon le point 23 de l’arrêt Wallentin, précité, un problème technique peut être compté au nombre des «défaillances imprévues pouvant affecter la sécurité du vol» et est dès lors un «évènement» au sens du point 22 du même arrêt; il n’en reste pas moins que les circonstances entourant cet évènement peuvent être qualifiées d’extraordinaires, si elles concernent un évènement qui n’est pas inhérent à l’exercice normal des activités du transporteur aérien et qui échappe à la maîtrise effective de celui-ci du fait de sa nature ou de son origine, aux termes du point 23 de l’arrêt Wallentin, précité; selon le point 24, résoudre un problème technique imputable à un entretien défectueux est inhérent à l’exercice normal de l’activité du transporteur aérien; c’est la raison pour laquelle de tels problèmes techniques ne sauraient constituer des circonstances extraordinaires, selon le point 25 de l’arrêt Wallentin.
It is apparent from paragraph 23 of the Wallentin judgment that a technical problem can be considered to be covered by ‘unexpected flight safety shortcomings’ and is therefore an ‘event’ within the meaning of paragraph 22 of the Wallentin judgment; the circumstances surrounding that event may nevertheless be regarded as extraordinary if they relate to an event which is not inherent in the normal exercise of the activities of the air carrier and beyond the actual control of that carrier on account of its nature or origin, as provided in paragraph 23 of the Wallentin judgment; according to paragraph 24 thereof, the resolution of a technical problem which can be traced back to poor maintenance of an aircraft is inherent in the normal exercise of an air carrier’s activity; therefore, according to paragraph 25 of the Wallentin judgment, such technical problems cannot constitute extraordinary circumstances.

An air carrier can only rely on extraordinary circumstances if it can prove that the cancellation/delay is caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken.

If question 6 is answered to the effect that technical problems which are considered to be unexpected flight safety shortcomings constitute extraordinary circumstances which may justify invoking Article 5(3) of the Regulation if they arise from an event which is not inherent in the exercise of the activities of the airline and is beyond the actual control of the latter, does that then mean that a technical problem which arose spontaneously and is not attributable to poor maintenance and was moreover not detected during routine maintenance checks (the said A-D Checks and the Daily Control .) can or cannot constitute an extraordinary circumstance — on the assumption that it could not be detected during the regular maintenance operations — because then no event as referred to in paragraph 26 can be identified and it is therefore also not possible to determine whether such an event is inherent in the exercise of the activities of the airline and is thus beyond the control of the air carrier?

Il semble ressortir de ces points qu’un problème technique qui relève de «défaillances imprévues pouvant affecter la sécurité du vol» est en même temps un évènement qui peut s’accompagner de circonstances extraordinaires, et même constituer une circonstance extraordinaire.
It appears to follow from those paragraphs that a technical problem which is covered by ‘unexpected flight safety shortcomings’ is simultaneously an event which may be surrounded by extraordinary circumstances and may itself constitute an extraordinary circumstance.

For the purposes of this Regulation, extraordinary circumstances shall include the circumstances set out in the non-exhaustive list in Annex 1. The Commission shall be empowered, by means of a delegated act in accordance with Article 16d, to add circumstances to the list in Annex 1, which are to be considered as extraordinary circumstances for the purposes of this Regulation;

3. An operating air carrier shall not be obliged to pay compensation in accordance with Article 7 if it can prove that the cancellation is caused by extraordinary circumstances. The Commission shall report to the European Parliament and the Council by 1 January 2017 on the operation and the results of this Regulation, in particular with regard to the impact of the compensation for long delays and the limitation of accommodation in extraordinary circumstances of long duration, issues concerning the interpretation of extraordinary circumstances, the statistics published by the National Enforcement Bodies on their activities, including on sanctions and their findings regarding suspected infringing practices by air carriers, the progress made in establishing national bodies responsible for the out-of-court resolution of disputes and the activities of the latter .

Calls on the Commission, in any upcoming revision of the Regulation, to adopt clarifications of the notion of ‘extraordinary circumstances’ and the definition of ‘cancellation’ as well as the rules governing provision of assistance and the right to redress and compensation; any such review should take note of the level of passenger protection provided by the ECJ rulings as well as the Court's interpretation of ‘extraordinary circumstances’; regards these measures as important, given the current scope that exists for challenges to compensation rules, variation in national enforcement and incidences such as the 2010 volcanic ash crisis;
