35. Recommends that an economic operator should be excluded for at least five years from participation in any public contract throughout the EU if that operator has been the subject of a conviction by final judgment for participation in a criminal organisation, money laundering or terrorist financing, exploitation of human beings or child labour, corruption or any other serious offence against the public interest wherever such offences undermine the fiscal capacity of the State or produce social harm, such as, for example, tax evasion and other tax-related offences, or for any other particularly serious crimes with a cross-border dimension, as referred to in Article 83(1) TFEU (so-called Eurocrimes), whilst fully respecting the rights of defence in accordance with the ECHR, the EU Charter and secondary EU legislation pertaining to the rights of suspects and accused persons in criminal matters, and that the above provision should apply even when the grounds for exclusion arise in the course of the award procedure; recommends further that economic operators registered in tax havens recognised as such by international organisations be excluded from participating in a public contract;

I. whereas civil society has a crucial role to play in the democratic transition in Egypt, and must be allowed to operate freely; whereas the right of association goes hand in hand with, and is dependent on, the right to access funding; whereas international and domestic NGOs are facing increasing pressure, hostile attacks, harassment and intimidation in the country; whereas, on 4 June 2013, a Cairo criminal court sentenced 43 foreign and Egyptian NGO workers to up to five years in prison for civil society activities and ordered the closure and the confiscation of assets of local branches of five international NGOs which had been operating in Egypt for a long time, namely the Konrad Adenauer Foundation, the National Democratic Institute, the International Republican Institute, Freedom House and the International Center for Journalists; whereas these court sentences are part of a campaign of intimidation by Egyptian government authorities against NGOs;

21. Calls on the Commission to work for the inclusion of social clauses in international treaties, and to do so on the basis of the five International Labour Organization (ILO) conventions considered to be priorities, namely the right to organise, freedom of assembly, and the elimination of child labour, forced labour, and discrimination; calls for the implementation of these social clauses to be backed up by positive measures and incentives for countries and companies to abide by them; calls on the Commission and Council to work to ensure that this matter is again placed on the agenda at the World Trade Organization ministerial conference, and that a committee for trade and human rights is created to deal in particular with issues of human rights in the working world;
