(73) The amounts of DEM 2124 and DEM 2740 million that Germany is proposing to grant to the coal industry under Article 5 of Decision No 3632/93/ECSC, for 2000 and 2001 respectively, are intended to cover the costs arising from or having arisen from the modernisation, rationalisation or restructuring of the coal industry which are not related to current production (inherited liabilities).

Having regard to Commission Decision 1999/270/ECSC of 2 December 1998 authorising Germany to grant aid to the coal industry for 1998 and also giving a favourable opinion on the compatibility with Decision No 3632/93/ECSC of the new guidelines for coal policy up to the year 2002(2),

In Germany and Spain, which have substantial coal reserves but difficult geological conditions and where employment in the coal industry has remained relatively high and is still vitally important for the industrial areas concerned, there has been a combination of closures of the least efficient mines and cost-cutting measures.

The Commission has taken this opportunity to remind the Government of the Federal Republic of Germany that failure to meet its obligations regarding in particular the submission of a restructuring, rationalization and modernization plan, as required by the Decision of 30 March 1989, will, if continued, make it impossible for the Commission to take any decision on the German coal industry.

The Commission, which is aware of the social and regional context which characterizes the German coalmining industry, has today granted aid to the German coalmining industry for 1992 pursuant to Decision 2064/86/ECSC.
