– having regard to the EU’s textual proposals tabled for discussion with the US in the TTIP negotiating rounds, in particular those which have been declassified and made public by the Commission, inter alia the EU position papers entitled ‘TTIP regulatory issues - engineering industries’ , ‘Test–case on functional equivalence: proposed methodology for automotive regulatory equivalence’ , and ‘Trade and sustainable development chapter/labour and environment: EU paper outlining key issues and elements for provisions in the TTIP’ , and the textual proposals on technical barriers to trade (TBT) , sanitary and phytosanitary measures (SPS) , customs and trade facilitation , small and medium-sized enterprises (SMEs) , possible provisions on competition , possible provisions on state enterprises and enterprises granted special or exclusive rights or privileges , possible provisions on subsidies , and dispute settlement , initial provisions on regulatory cooperation ,

Selon nous, ces forces négatives qui s'exercent sur le marché du livre canadien remontent directement à la décision malavisée et mal informée du Bureau de la concurrence d'approuver la fusion en 1995 des librairies SmithBooks, Librairie Smith, Coles, The Book Company et Classics en une seule chaîne anglophone nationale de vente au détail, Chapters Inc. Cette fusion s'est soldée depuis cinq ans par la fermeture de centaine de ces librairies qui avaient fusionné dans la chaîne Chapters Inc. et par la fermeture de centaines d'autres librairies indépendantes à cause des pratiques commerciales déloyales du volet grande surface de Chapters Inc., cette concurrence inéquitable étant financée par les autres librairies de la chaîne, celles que Chapters appelle ses «librairies traditionnelles».
We believe the origin of these negative forces within the Canadian book market can be traced directly to the misinformed and misguided approval by the Competition Bureau of the merger of SmithBooks, Librairie Smith, Coles, The Book Company, and Classics bookstores into a single anglophone national retail chain, Chapters Inc., in 1995. This merger has resulted, over the last five years, in the closure of hundreds of these former chain bookstore outlets by Chapters Inc. itself and in the further closure of hundreds more independent bookstores because of the predatory trade practices of the superstore portion of Chapters Inc., an unequal competition internally subsidized by its other chain outlets, which Chapters calls its “traditional stores”.

We also believe the recent creation of Chapters Inc'. s majority-owned and vertically integrated companies, Pegasus Inc. and Chapters online, has accelerated these negative market forces and that the Competition Bureau should therefore have ruled against their creation by Chapters Inc.
