Le parlement a adopté, en mai, une nouvelle loi sur la confiscation des avoirs afin d'améliorer les résultats de ces saisies[54]. Pour la première fois, cette loi offre la possibilité de confisquer des avoirs illégaux via une procédure auprès des tribunaux civils, qui ne nécessite aucune condamnation préalable, et qui peut être lancée dès l'ouverture d'une enquête judiciaire pour toute une série de délits graves et pour certaines infractions administratives.
To improve effective asset forfeiture, a new asset forfeiture act was adopted by Parliament in May.[54] This law offers for the first time the possibility to confiscate illegal assets through a procedure in civil courts which does not require a prior conviction, but can be launched upon the initiation of judicial investigations for a number of serious crimes and upon certain administrative infringements.

In view of the analysis, the Commission asked Member States to report on "Existing national law establishing as a criminal offence the use of services which are the objects of exploitation of trafficking in human beings; who is precisely criminalised; if criminalisation for all forms of exploitation is envisaged; if legislation requires proving the element of knowledge that the person is a victim of trafficking and how it impacts the applicability of the legislation; what measures were taken to ensure that the public is aware of the law to ensure better implementation; available statistical data on prosecutions and convictions and hurdles faced; if there is no existing national law, what are the reasons and what alternatives are in place to fulfil the obligation of considering criminalisation; how they assess the impact of such laws and if they have relevant suggestions; what consultation processes are in place and; if they have commissioned any evaluation and research of such laws".

If that information does not comply with the terms of the undertaking or the applicable law, any local creditor may challenge such distribution before the courts of the Member State in which main insolvency proceedings have been opened in order to obtain a distribution in accordance with the terms of the undertaking and the applicable law.

The courts may, however, in specific cases where their law so requires, appoint a third party as administrator even if this is not provided for in the law applicable to the succession.
