Nous avons décidé de voter contre la modification de la décision instituant le CEPOL, qui prévoit le déménagement de cette agence de Bramshill (Royaume-Uni) à Budapest (Hongrie), car nous estimons qu'elle constitue un dangereux précédent institutionnel dans l'Union européenne par rapport aux sièges des organes et agences de l'Union. En effet, alors que la Commission proposait de fusionner le CEPOL avec Europol à La Haye, le Conseil a décidé d'accepter la décision unilatérale d'un État membre de ne plus héberger le siège de cette agence à l'endroit prévu ni même ailleurs sur son territoire. Il a débattu de plusieurs candidatures à l'accueil du CEPOL lors d'un déjeuner informel, niant en cela le droit du Parlement européen d'examiner les évaluations des incidences budgétaires de ce déménagement. Or, la réunion du CEPOL et d'Europol est raisonnablement la meilleure voie à suivre pour garantir la minimisation des coûts et l'amélioration des synergies. Le Conseil ne précise pas qui financera le déménagement du CEPOL et laisse cette agence et son personnel dans l'incertitude. Comme il ressort de son document n° 6476/14, il a entrepris l'examen d'une nouvelle révision de la décision instituant le CEPOL, ce qui nous amène à la conclusion qu'il eût mieux valu inviter le Conseil à communiquer au Parlement des analyses d'incidences détaillées et à attendre la révision complète de ladite décision.
We decided to vote against the Decision on Cepol as amended foreseeing to move Cepol from Bramshill (UK) to Budapest (HU) as we believe that this creates a dangerous institutional precedent in the EU in relation to the location of bodies and agencies: while the Commission proposed to merge Cepol with Europol in The Hague, the Council decided to accommodate the unilateral decision of a Member State not to host such body anymore in the foreseen location or within the same Member State; it discussed during an informal lunch different location candidatures, denying to the EP the right to examine the accompanying budgetary impact assessments; the co-location of Cepol and Europol reasonably appears to be the best option to ensure that costs are minimized and synergies improved; it is unclear who will pay for the relocation, while Cepol and its staff members are subjected to uncertainty; the Council is discussing a further review of the Cepol Decision, as illustrated in Council document 6476/14, which leads us to the conclusion that it would have been better to call the Council to provide the EP with a detailed impact assessments and wait for the Cepol decision to be reviewed in its entirety.

Par dérogation à l'article 7, paragraphe 2, et à l'article 9, paragraphe 2, de la décision-cadre 2009/315/JAI du Conseil relative à l'organisation et au contenu des échanges d'informations extraites du casier judiciaire entre les États membres, les États membres prennent les mesures nécessaires pour que, aux fins de la mise en œuvre effective de la mesure consistant à empêcher provisoirement ou définitivement la personne d'exercer des activités impliquant des contacts réguliers avec des enfants, notamment dans la mesure où l'État membre demandeur subordonne l'accès à certaines activités au respect de conditions pour s'assurer que les candidats n'aient pas été condamnés pour l'une des infractions visées aux articles 3 à 7 de la présente directive, les informations relatives à une mesure d'interdiction suivant une condamnation pour l'une des infractions visées aux articles 3 à 7 de la présente directive soient transmises à la suite d'une demande introduite conformément à l'article 6 de cette décision-cadre auprès de l'autorité centrale de l'État membre de nationalité, et que les données à caractère personnel relatives à cette mesure d'interdiction fournies conformément à l'article 7, paragraphes 2 et 4, de cette décision-cadre puissent être utilisées à cette fin dans tous les cas.
3. By way of derogation from Articles 7 (2) and 9 (2) of the Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records between Member States, Member States shall take the necessary measures to ensure that, for the purpose of effectively implementing the measure consisting in temporarily or permanently preventing the person from exercising activities involving regular contacts with children, in particular insofar as the requesting Member State subjects access to certain activities to conditions to ensure that candidates have not been convicted of any of the offences referred to in Articles 3 to 7 of this Directive, information concerning the disqualification arising from conviction of any of the offences referred to in Articles 3 to 7 of this Directive is transmitted when requested under Article 6 of that Framework Decision from the central authority of the Member State of the person’s nationality, and that personal data concerning such disqualification provided under Article 7(2) and (4) of that Framework Decision may in all cases be used for such purpose.

3. Par dérogation à l'article 7, paragraphe 2, et à l'article 9, paragraphe 2, de la décision-cadre 2009/315/JAI du Conseil relative à l'organisation et au contenu des échanges d'informations extraites du casier judiciaire entre les États membres, les États membres prennent les mesures nécessaires pour que, aux fins de la mise en œuvre effective de la mesure consistant à empêcher provisoirement ou définitivement la personne d'exercer des activités impliquant des contacts réguliers avec des personnes âgées de moins de dix-huit ans, notamment dans la mesure où l'État membre demandeur subordonne l'accès à certaines activités au respect de conditions pour s'assurer que les candidats n'aient pas été condamnés pour l'une des infractions visées aux articles 3 à 7 de la présente directive, les informations relatives à une mesure d'interdiction suivant une condamnation pour l'une des infractions visées aux articles 3 à 7 de la présente directive soient transmises à la suite d'une demande introduite conformément à l'article 6 de cette décision-cadre auprès de l'autorité centrale de l'État membre de nationalité, et que les données à caractère personnel relatives à cette mesure d'interdiction fournies conformément à l'article 7, paragraphes 2 et 4, de cette décision-cadre puissent être utilisées à cette fin dans tous les cas.

Cette décision-cadre respecte les droits fondamentaux ainsi que les principes inscrits dans l'article du traité, qui se reflètent dans la Charte des droits fondamentaux de l'Union européenne, et notamment dans son chapitre VI. Aucune disposition de cette décision-cadre ne doit être interprétée comme interdisant le refus d'exécuter une décision lorsqu'il existe des raisons objectives de croire que la condamnation a été imposée aux fins de punir une personne au motif de son sexe, de sa race, de sa religion, de son origine ethnique, de sa nationalité, de sa langue, de ses opinions politiques ou de son orientation sexuelle, ou qu'il peut être porté préjudice à la position de cette personne pour l'un de ces motifs.
This Framework Decision respects fundamental rights and observes the principles recognised by Article 6 of the Treaty and reflected by the Charter of Fundamental Rights of the European Union, in particular Chapter VI thereof. Nothing in this Framework Decision should be interpreted as prohibiting refusal to execute a decision when there are objective reasons to believe that the sentence was imposed for the purpose of punishing a person on the grounds of his or her sex, race, religion, ethnic origin, nationality, language, political opinions or sexual orientation, or that that person's position may be prejudiced on anyone of those grounds.
