Welcomes the action plan aimed at fighting the smuggling of cigarettes and alcohol along the EU’s eastern border, and notes that this illegal activity is leading to significant financial losses for the EU budget and for the budgets of the Member States (estimated at EUR 10 billion per year); emphasises that this activity serves as an important source of financing for internationally structured criminal organisations, and highlights, therefore, the importance of strengthening the external dimension of the aforementioned action plan, which provides for supporting enforcement capacity in neighbouring countries, offering technical assistance and training, raising awareness, stepping up operational cooperation, such as Joint Customs Operations (JCO), sharing intelligence and enhancing international cooperation; stresses, in particular, the importance of collaboration between the Member States, Russia and the Eastern Partnership countries (Armenia, Azerbaijan, Belarus, Georgia, Moldova and Ukraine) for the implementation of the targeted actions proposed in the action plan;

(Return tabled) Question No. 1147 Mr. Massimo Pacetti: With regard to the response provided by the Minister of International Cooperation to written question Q-972 on the Order Paper, in which the Minister states: “Since 2006, there has been (1) entity in receipt of CIDA funding while being under legal protection from creditors; however, this entity continues to meet its contractual obligations and is delivering results through its programming”: (a) what is the name of the entity referred to in this response; (b) what are all the projects for which this entity is receiving or has received funding from the Canadian International Development Agency (CIDA) while under legal protection from creditors; (c) what is the amount of funding that this entity is receiving or has received from CIDA while under legal protection from creditors; (d) what are the beginning and end dates for any projects this entity has undertaken with the assistance of CIDA funding while under legal protection from creditors; (e) what is the specific date on which this entity obtained legal protection from creditors; (f) what were the recommendations by CIDA to the Minister of International Cooperation with regard to any projects that this entity sought to undertake with funding from CIDA since 2006; and (g) what are all the decisions rendered by the Minister of International Cooperation with regard to any projects that this entity sought to undertake with funding from CIDA since 2006?

The legal basis chosen for this proposal for a Council Decision to renew the Agreement concluded between the EC and India for a scientific and technological cooperation between the two parties to the 2002 Agreement is dual. First, the basic article of the EC Treaty making provision for international cooperation is Article 170. Second, cooperation between the EC and third countries of international organisations is governed by the provisions of Article 300, for both opening negotiations and for concluding the agreed text.

It is disappointing to note that most of the specific problems, such as sources of finance, international cooperation, the modernization of national legislation and even the need to link voluntary organizations/foundations with developments in the information society, would no longer arise or would be much less acute if these bodies were equipped with an instrument of cooperation at Community level: we are of course referring to the Statute for a European Association which Parliament has called for in two reports drawn up by this committee- see the FONTAINE Report on non-profit-making associations (Doc. A2-196/86) and the VAYSSADE Report on a Statute for a European Cooperative Society and other undertakings in the mutual sector in general (Doc. A3-312/90) - and it approved the proposal for a regulation relating to that statute through the VAYSSADE Report which concerned the statutes for a European association, European cooperative society and a European mutual society (Doc. A3-0001/93) OJ C 42 of 15.2.1993, pp. 84 to 122).
