Finally, it is important to note that, by basing the decision approving the Convention on the dual legal basis of Article 133 EC and Article 175(1) EC, the Community is also giving indications to the other parties to the Convention both with regard to the extent of Community competence in relation to that Convention which, as has been shown earlier, falls both within the scope of the common commercial policy and within that of the Community environmental policy, and with regard to the division of competences between the Community and its Member States, a division which must also be taken into account at the stage of implementation of the agreement at Community level.

What the Convention should, in my view, produce is a coherent text, underpinned by its own logic, not a mere shopping list; a text adopted by consensus, which therefore does not seek unanimity at any price and which, to avoid scaling down its essential ambitions, voices minority views where necessary; a simpler, more easily readable text which clearly sets out not only the principles guiding our action – and the Charter of Fundamental Rights should be at the heart of those principles – but also the goals to which we are aspiring; a text which makes the way in which the European public authorities work more transparent, that is which gives a clear description of both the institutions and the instruments necessary for achieving the objectives they are assigned; and lastly, a text that is capable of evolving and is therefore, to this end, a combination of a set of fundamental rules and some more technical provisions.

CONVENTION RELATIVE AUX PROCEDURES D'INSOLVABILITE Le Conseil a - constaté l'accord de quatorze délégations sur l'actuel projet de texte de la Convention ; - donné mandat au Comité des Représentants permanents de poursuivre les travaux en s'efforçant de rechercher des bases de rapprochement permettant à dégager un accord unanime ainsi que pour préparer le rapport explicatif attendu pour l'approbation finale par le Conseil. Le projet de convention est basé sur le principe de l'universalité atténuée, c'est-à-dire sur une approche fondée sur une procédure principale d'insolvabilité ouverte dans l'Etat contractant où le débiteur a le centre de ses intérêts principaux et la possibilité d'ouvrir des procédures secondaires ou territoriales là où le débiteur a un établissement. La procédure principale aurait des effets dans tous les Etats contractants et les procédures territoriales et secondaires auraient des effets limités au territoire de l'Etat contractant où elles seraient ouvertes. This right would make it possible for a manufacturer to prevent the non-authorized extraction and/or the re-utilization of the whole or a substantial part of the contents of a database - without prejudice, however, to application of the rules of competition (especially as regards the abuse of dominant positions and abusive practices. The protection granted by this right would apply for fifteen years after the completion of a database. The Member States would have the option of providing for certain exceptions to the sui generis right, in particular as regards extractions for private purposes or illustration in teaching. Under the common position, the sui generis right could be extended to databases manufactured in third countries, on the basis of reciprocal agreements. The Member States should transpose the Directive into their national legislation before 1 January 1998. CONVENTION ON INSOLVENCY PROCEEDINGS The Council - noted the agreement of fourteen delegations on the current draft text of the Convention; - instructed the Permanent Representatives Committee to continue its proceedings and seek bases for rapprochement such that unanimous agreement could be reached and to prepare the explanatory report awaited for final approval by the Council. The draft Convention is based on the principle of attenuated universality, i.e. on an approach based on main insolvency proceedings opened in the Contracting State in which a debtor has the centre of his main interests and the possibility of opening secondary or territorial proceedings wherever he is established. The main proceedings would produce effects in all the Contracting States and the territorial and secondary proceedings would produce effects restricted to the territory of the Contracting State where they were opened. This approach represents a compromise which endeavours to take into account the various legal traditions in the Member States.

Cette initiative revêt un caractère global et comprend trois composantes, à savoir : - un moratoire sur l'exportation des mines, qui vise à affirmer vis-à- vis de l'extérieur l'engagement de l'Union ; - la préparation de la Conférence de révision de la Convention de 1980 dite sur les "mines inhumaines", avec l'indication des objectifs que l'Union poursuivra dans cette Conférence ; il s'agira notamment de renforcer les interdictions et limitations du Protocole nu 2 qui couvre les mines ; - une large contribution de l'Union à l'effort international de déminage. Celle-ci consiste à concourir au financement de la conférence internationale de déminage, organisée sous l'égide du Secrétaire Général des Nations Unies, contribuer au fonds de déminage des Nations Unies, enfin à conduire des opérations de déminage propres à l'Union.
The initiative concerned is general in scope and comprises three components: - a moratorium on the export of mines, aimed at affirming the Union's commitment externally; - preparation for the Review Conference on the 1980 Convention on "inhuman weapons", including indication of the objectives which the Union will be pursuing at that Conference; this will mainly involve a tightening of the bans and limitations provided for in Protocol No 2, which covers mines; - a major Union contribution to international mine clearance; this will consist of participation in the funding of the International Conference on mine clearance organized under the aegis of the United Nations Secretary-General, a contribution to the United Nations mine-clearance fund and, finally, mine-clearance operations by the Union itself.
