Contrairement à cette conclusion, Elefsis Shipyards fait valoir que cette garantie n’était pas nécessaire et que, précisément, elle aurait été disposée à acquérir HSY sans la garantie, ce qui est prouvé par le fait que dans son offre de rachat de HSY elle ne posait pas la garantie comme préalable à l’acquisition en question.
Contrary to this conclusion, Elefsis claims that this guarantee was not necessary and claims in particular that it would have been ready to purchase HSY without such a guarantee, what is illustrated by the fact that, in its bid for the purchase of HSY, it did not put this guarantee as a condition for purchasing HSY.
