Quatorze chambres de parlements nationaux de onze États membres (Bulgarie, République tchèque, Croatie, Danemark, Estonie, Hongrie, Lettonie, Lituanie, Pologne, Roumanie et Slovaquie) ont émis des avis motivés affirmant que la proposition n’était pas conforme au principe de subsidiarité, ce qui a déclenché le mécanisme de contrôle de la subsidiarité (la procédure dite du «carton jaune»).
14 chambers of national Parliaments from 11 Member States (Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Hungary, Latvia, Lithuania, Poland, Romania and Slovakia) sent reasoned opinions claiming that the proposal was in breach of the principle of subsidiarity. This triggered the subsidiarity control mechanism (the so-called 'yellow card' procedure).

Emphasises that the Lisbon Treaty gives national parliaments a substantially stronger role in vetting compliance with the principle of subsidiarity, by introducing two specific mechanisms; in each case, national parliaments will have a period of eight weeks (which the Commission is obliged to grant them) in which to react to legislative proposals; first, if one-third of the chambers of the parliaments in the EU give a reasoned opinion that a given legislative proposal does not comply with the principle of subsidiarity, the Commission will be obliged to reconsider it; second, if a majority of the chambers of the parliaments of the Union give a reasoned opinion opposing a draft legislative act on the ground that it fails to comply with the principle of subsidiarity, both the European Parliament and the Council will have to vote on that question before Parliament makes any pronouncement in first reading on the substance;
