Must Questions 1 and 2 be answered in the same way in the case of a (former) seaman who, at the time of his employment, was a national of a State which at a later date accedes to (a legal predecessor of) the European Union, but who, at the time of that accession or the entry into force of Regulation No 1408/71 for that State, and at the time of submitting his claim to entitlement to an old-age pension, was not a national of any Member State, but to whom Regulation No 1408/71 nevertheless applies pursuant to Article 1 of Regulation No 859/2003 (2)?

Since that prohibition was, in particular, inserted by the Act of Accession of Ireland and the United Kingdom to the European Communities – the only Member States at that time which drove on the left - it cannot reasonably be considered that the EU legislature was unaware of the fact that the accession of those Member States (one of which was a manufacturer of vehicles with their driver’s seat on the right-hand side) was liable, in an internal market involving the right to free movement, to have an effect on driving habits, even to involve a certain risk connected with road traffic.

Finally, as regards Austria's international obligations, the Court stated that it is for the national court to check whether at the date of the accession of the Republic of Austria to the European Union (1 January 1995), that State remained bound to the Czech Republic under the bilateral convention of 1976, notwithstanding the break-up of Czechoslovakia the contracting party to the bilateral convention and the predecessor to the Czech Republic on 1 January 1993: if that were the case, the bilateral convention could be regarded as predating that accession, with the result that the obligations under the bilateral convention remain binding even where they are contrary to the provisions of the Treaty relating to the free movement of goods.
