Le Tribunal aurait ainsi erronément présumé qu’un signe autre que verbal n’avait aucun pouvoir distinctif lorsqu’il n’était pas utilisé en combinaison avec un élément verbal, alors que ni ce règlement ni la jurisprudence ne soumettraient l’enregistrement d’une marque constituée de la forme de présentation d’un produit ou de la présentation de son conditionnement à la présence d’inscriptions ou d’éléments verbaux.
The Court also erroneously presumed that a non verbal sign had no distinctive power when not used in combination with a word element, although neither that regulation nor the case‑law makes the registration of a mark constituted by the shape of a product or the presentation of its packaging subject to the presence of inscriptions or word elements.

En effet, au lieu de vérifier si les marques dont l’enregistrement était demandé divergeaient de manière significative de la norme ou des habitudes du secteur, le Tribunal s’est limité à constater de manière générale, aux points 79 et 78 respectivement des arrêts T‑109/08 et T‑110/08, que, aucune bouteille n’étant vendue sans étiquette ni mention équivalente, seul cet élément verbal permettait de déterminer l’origine du vin mousseux concerné de sorte que la couleur et le matage du verre de la bouteille ne pouvaient pas «fonctionner comme marque» pour le vin mousseux en ce qui concerne le public pertinent, lorsqu’ils n’étaient pas utilisés en combinaison avec un élément verbal.
Instead of establishing whether the marks for which registration was sought varied significantly from the norm or customs of the sector, the General Court merely stated in a general manner, at paragraphs 79 and 78 of the judgments in T-109/08 and T-110/08 respectively, that since no bottle had been sold without a label or an equivalent, only that word element could determine the origin of the sparkling wine in question, so that the colour and matting of the glass of the bottle could not ‘function as a trade mark’ for sparkling wine for the relevant public when they were not used in combination with a word element.

Une telle appréciation conduit systématiquement à exclure de la protection susceptible d’être conférée par le règlement nº 40/94 les marques constituées par l’apparence du conditionnement du produit lui-même ne comportant pas d’inscription ou d’élément verbal.
Such an assessment means that marks consisting of the appearance of the packaging of the product itself that do not contain an inscription or a word element would be excluded automatically from the protection that may be conferred by Regulation No 40/94.

Freixenet reproche également au Tribunal d’avoir violé l’article 7, paragraphe 1, sous b), du règlement nº 40/94 par l’importance qu’il a attachée à la nécessité de combiner un élément verbal avec les marques dont l’enregistrement était demandé en faisant sienne, aux points 82 et 81 respectivement des arrêts T‑109/08 et T‑110/08, la considération de la chambre de recours de l’OHMI selon laquelle «il n’existe aucun antécédent d’entreprises vinicoles ayant offert du vin au public dans des bouteilles sans inscriptions, en faisant uniquement ou principalement confiance à l’aspect formel de la bouteille en tant qu’indicateur de l’origine industrielle ou commerciale du produit».
Freixenet also accuses the Court of having infringed Article 7(1)(b) of Regulation No 40/94 by the importance which it attached to the need to combine a word element with the marks for which registration was sought when it endorsed, at paragraphs 82 and 81 of the judgments in T-109/08 and T-110/08 respectively, the argument of the Board of Appeal that ‘there is no history of wine producers having offered wine to the public in bottles without inscription, by solely or principally relying on the formal appearance of the bottle as the indicator of the industrial or commercial origin of the product’.

En effet, les consommateurs moyens n’ont pas pour habitude de présumer l’origine des produits en se fondant sur leur forme ou celle de leur emballage, en l’absence de tout élément graphique ou textuel, et il pourrait donc s’avérer plus difficile d’établir le caractère distinctif s’agissant d’une telle marque tridimensionnelle que s’agissant d’une marque verbale ou figurative (arrêts de la Cour du 7 octobre 2004, Mag Instrument/OHMI, C‑136/02 P, Rec. p. I‑9165, point 30 ; du 12 janvier 2006, Deutsche SiSi-Werke/OHMI, C‑173/04 P, Rec. p. I‑551, point 28, et du 22 juin 2006, Storck/OHMI, C‑24/05 P, précité, point 25).
Average consumers are not in the habit of making assumptions about the origin of products on the basis of their shape or the shape of their packaging in the absence of any graphic or word element, and it could therefore prove more difficult to establish distinctiveness in relation to such a three-dimensional mark than in relation to a word or figurative mark (see Case C‑136/02 P Mag Instrument v OHIM [2004] ECR I-9165, paragraph 30; Case C‑173/04 P Deutsche SiSi-Werke v OHIM [2006] ECR I-551, paragraph 28, and Case C-24/05 P Storck v OHIM, paragraph 25.)
