Definition: This category differs from others in that it includes disorders identifiable on the basis of not only symptoms and course but also the existence of one or other of two causative influences: an exceptionally stressful life event producing an acute stress reaction, or a significant life change leading to continued unpleasant circumstances that result in an adjustment disorder. Although less severe psychosocial stress ( life events ) may precipitate the onset or contribute to the presentation of a very wide range of disorders classified elsewhere in this chapter, its etiological importance is not always clear and in each case will be found to depend on individual, often idiosyncratic, vulnerability, i.e. the life events are neither necessary nor sufficient to explain the occurrence and form of the disorder. In contrast, the disorders brought together here are thought to arise always as a direct consequence of acute severe stress or continued trauma. The stressful events or the continuing unpleasant circumstances are the primary and overriding causal factor and the disorder would not have occurred without their impact. The disorders in this section can thus be regarded as maladaptive responses to severe or continued stress, in that they interfere with successful coping mechanisms and therefore lead to problems of social functioning.

9. Les DCT, les contreparties centrales et les plates-formes de négociation mettent en place des procédures qui leur permettent, après avoir consulté leurs autorités compétentes respectives, de suspendre un participant qui manque constamment et systématiquement à son obligation de livrer les instruments financiers visés à l’article 5, paragraphe 1, à la date de règlement convenue, et de publier son identité, uniquement après avoir donné à ce participant la possibilité de présenter ses observations et à condition que les autorités compétentes des DCT, des contreparties centrales et des plates-formes de négociation, ainsi que les autorités compétentes du participant concerné, aient été dûment informées. 9. CSDs, CCPs and trading venues shall establish procedures that enable them to suspend in consultation with their respective competent authorities, any participant that fails consistently and systematically to deliver the financial instruments referred to in Article 5(1) on the intended settlement date and to disclose to the public its identity only after giving that participant the opportunity to submit its observations and provided that the competent authorities of the CSDs, CCPs and trading venues, and of that participant have been duly informed. In addition to consulting before any suspension, CSDs, CCPs and trading venues shall notify, without delay, the respective competent authorities of the suspension of a participant.

Your rapporteur thinks that the best execution rule should be complemented by comprehensive transparency requirements requiring market participants to make public the terms on which they are willing to trade (pre-trade transparency) and details of transactions they have executed (post-trade transparency) to ensure efficient markets and provide investor protection.
