Calls on the Commission to propose legislation which will enable European companies to manufacture generic and biosimilar medicines in the EU during the supplementary protection certificate (SPC) period, following the expiry of patent protection, in order to prepare for immediate launch following expiration of the SPC or to export to countries where no patent or SPC is in place; believes that such provisions could help to avoid the outsourcing of production and to foster job creation in the EU, as well as to create a level playing field between European companies and their competitors in third countries;

For the purposes of this Agreement: "intellectual property" shall have the meaning given in Article 2 of the Convention establishing the World Intellectual Property Organisation, done at Stockholm on 14 July 1967, "knowledge" shall mean the results, including information, whether or not they can be protected, as well as copyrights or rights pertaining to such information following applications for, or the issue of patents, designs, plant varieties, supplementary protection certificates or similar forms of protection.

This strategy will give a considerable boost to inter-regional cooperation and will have the following objectives: the development and modernisation of river transport on the Rhine/Meuse-Main-Danube waterway, as well as road and rail transport in the Danube Region; the development and efficient use of renewable energy resources with a view to cutting carbon emissions and increasing energy security; the protection of the environment through implementing projects intended to restore and protect the ecosystems in the region; efficient absorption of EU funds and the attraction of investments, the promotion of tourism, all of which feature in the EU 2020 strategy.

(2) Whereas the marketing of goods infringing patents or supplementary protection certificates for medicinal products as provided for in Council Regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products (5) or supplementary protection certificates for plant protection products, as provided for in Regulation (EC) No 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products (6) causes serious injury to their holders and constitutes an unfair and unlawful business activity; whereas such goods should as far as possible be prevented from being placed on the market and measures should be adopted to that end to deal effectively with this unlawful activity without impeding the freedom of legitimate trade; whereas this objective is also being pursued through efforts being made along the same lines at international level;

À cet égard, la Commission entend soumettre une proposition visant à instituer un certificat complémentaire de protection communautaire prolongeant la protection conférée par les brevets communautaires, comme c'est le cas pour les brevets nationaux en application du règlement (CEE) n° 1768/92 du Conseil, du 18 juin 1992, concernant la création d'un certificat complémentaire de protection pour les médicaments [JO L 182 du 2.7.1992, p. 1-5] et du règlement (CE) n° 1610/96 du Parlement européen et du Conseil, du 23 juillet 1996, concernant la création d'un certificat complémentaire de protection pour les produits phytopharmaceutiques [JO L 198 du 8.8.1996, p. 30-35].
In this regard, the Commission intends to come forward with a proposal for the creation of a Community supplementary protection certificate extending the protection conferred by Community patents in the way as is the case for national patents under Council regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products [OJ L 182, 2.7.1992, pp. 1-5] and regulation (EC) No 1610/96 of the European Parliament and the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products [OJ L 198, 8.8.1996, pp. 30-35].
