TRADUCTIONS EN CONTEXTE

Dans le cas de médicaments autorisés qui sont couverts par un certificat complémentaire de protection, conformément au règlement (CEE) no 1768/92, ou par un brevet pouvant donner lieu à l'octroi d'un certificat complémentaire de protection, l'article 7 du présent règlement est applicable aux demandes d'autorisation de nouvelles indications, y compris d'indications pédiatriques, de nouvelles formes pharmaceutiques et de nouvelles voies d'administration.
In the case of authorised medicinal products which are protected either by a supplementary protection certificate under Regulation (EEC) No 1768/92, or by a patent which qualifies for the granting of the supplementary protection certificate, Article 7 of this Regulation shall apply to applications for authorisation of new indications, including paediatric indications, new pharmaceutical forms and new routes of administration.

‘paediatric use marketing authorisation’ means a marketing authorisation granted in respect of a medicinal product for human use which is not protected by a supplementary protection certificate under Regulation (EEC) No 1768/92 or by a patent which qualifies for the granting of the supplementary protection certificate, covering exclusively therapeutic indications which are relevant for use in the paediatric population, or subsets thereof, including the appropriate strength, pharmaceutical form or route of administration for that product.

Calls on the Commission to propose legislation which will enable European companies to manufacture generic and biosimilar medicines in the EU during the supplementary protection certificate (SPC) period, following the expiry of patent protection, in order to prepare for immediate launch following expiration of the SPC or to export to countries where no patent or SPC is in place; believes that such provisions could help to avoid the outsourcing of production and to foster job creation in the EU, as well as to create a level playing field between European companies and their competitors in third countries;

In this regard, the Commission intends to come forward with a proposal for the creation of a Community supplementary protection certificate extending the protection conferred by Community patents in the way as is the case for national patents under Council regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products [OJ L 182, 2.7.1992, pp. 1-5] and regulation (EC) No 1610/96 of the European Parliament and the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products [OJ L 198, 8.8.1996, pp. 30-35].

U. considérant en particulier que la coopération renforcée dans ce domaine est conforme aux traités et au droit de l'Union puisqu'elle ne porte pas atteinte à l'acquis, dès lors qu'à ce jour, seul un nombre restreint d'actes juridiques de l'Union au sens de l'article 288 du traité sur le fonctionnement de l'Union européenne a été adopté, dont aucun ne concerne la création d'un titre européen de propriété intellectuelle assurant une protection uniforme dans toute l'Union; considérant que, hormis la directive 98/44/CE du Parlement européen et du Conseil du 6 juillet 1998 relative à la protection juridique des inventions biotechnologiques , il n'y a pas de rapprochement du droit matériel des brevets au niveau de l'Union, et que le règlement (CE) n° 1610/96 du Parlement européen et du Conseil du 23 juillet 1996 concernant la création d'un certificat complémentaire de protection pour les produits phytopharmaceutiques et le règlement (CE) n°469/2009 du Parlement européen et du Conseil du 6 mai 2009 concernant le certificat complémentaire de protection pour les médicaments portent sur la prolongation de la durée des brevets de certaines catégories particulières d'éléments brevetés; considérant que la coopération renforcée dans le domaine des brevets n'entraînerait pas de discrimination, l'accès au brevet unitaire étant ouvert à tous les usagers du système de brevet de l'ensemble de l'Union,
U. whereas, in particular, enhanced cooperation in this area complies with the Treaties and Union law since it will not affect the acquis , given that, to date, only a limited number of legal acts of the Union within the meaning of Article 288 TFEU have been adopted, none of them covering the creation of a European intellectual property right providing for uniform protection throughout the Union; whereas, with the exception of Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions , no approximation of substantive patent law exists at Union level, and whereas Regulation (EC) No 1610/96 of the European Parliament and of the Council of 23 July 1996 concerning the creation of a supplementary protection certificate for plant protection products and Regulation (EC) No 469/2009 of the European Parliament and of the Council of 6 May 2009 concerning the supplementary protection certificate for medicinal products concern patent term extensions for specific types of patented subject matter; whereas enhanced cooperation in the area of patents would not cause discrimination since access to the unitary patent will be open to users of the patent system from all over the Union,
