− (ES) Monsieur le Président, Monsieur le Vice-président de la Commission, Monsieur le Commissaire aux transports, Monsieur Tajani, Monsieur le Président en exercice du Conseil, Mesdames et Messieurs, personnellement, je ne peux pas imaginer une meilleure finalisation, au terme de cette législature, que l’adoption de cette proposition de directive sur la pollution causée par les navires et sur l’introduction de sanctions, y compris des sanctions pénales, pour les infractions de pollution. J’espère que celle-ci recevra l’appui de chacun.
− (ES) Mr President, Vice-President of the Commission, Commissioner for Transport, Mr Tajani, President-in-Office of the Council, ladies and gentlemen, personally, I cannot imagine a greater finishing touch to the end of this parliamentary term than the adoption of this proposal for a directive on ship-source pollution and the introduction of penalties, including criminal penalties for pollution offences, which I hope will receive everyone’s support.

Les articles 138, paragraphe 1, et 139, paragraphe 1, deuxième alinéa, de la directive 2006/112/CE du Conseil, du 28 novembre 2006, relative au système commun de taxe sur la valeur ajoutée, telle que modifiée par la directive 2010/88/UE du Conseil, du 7 décembre 2010, doivent être interprétés en ce sens qu’ils s’opposent à ce que, dans des circonstances telles que celles en cause au principal, l’administration fiscale d’un État membre refuse le bénéfice du droit à l’exonération de la taxe sur la valeur ajoutée au titre d’une livraison intracommunautaire au motif que l’acquéreur n’était pas identifié à cette taxe dans un autre État membre et que le fournisseur n’a démontré ni l’authenticité de la signature figurant sur les documents présentés à l’appui de sa déclaration de livraison prétendument exonérée ni le pouvoir de représentation de la personne ayant signé ces documents au nom de l’acquéreur, alors que les preuves justificatives du droit à l’exonération présentées par le fournisseur à l’appui de sa déclaration se conformaient à la liste de documents à présenter à ladite administration, fixée par le droit national, et qu’elles ont été acceptées par celle-ci, dans un premier temps, en tant que preuves justificatives, ce qu’il appartient à la juridiction de renvoi de vérifier.
Articles 138(1) and 139(1), second subparagraph, of Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax, as amended by Council Directive 2010/88/EU of 7 December 2010, must be interpreted as precluding, in circumstances such as those in the main proceedings, the tax authorities of a Member State from refusing to grant an exemption from value added tax in respect of an intra-Community supply of goods on the ground that the purchaser was not registered for value added tax purposes in another Member State and the supplier has proven neither the authenticity of the signature on the documents submitted in support of its declaration in respect of a supply it claims to be exempt from value added tax nor that the person who signed those documents on behalf of the purchaser had the authority to represent the purchaser, where the evidence establishing entitlement to the exemption submitted by the supplier in support of its declaration is consistent with the list of documents to be submitted to those authorities under national law and has been accepted by them, initially, as supporting evidence, which is a matter for the referring court to verify.

In view of the above, BE should be allowed to own or have rights of control over more than 2 020 MW of Restricted Capacity, for the period between the date on which it receives the notice from the banks and the date on which Eggborough’s capacity is no longer available to BE, or the end of the six year period referred to in recital (452) if earlier than the date on which where Eggborough’s capacity is no longer available to BE, under the condition that it does not operate the Restricted Capacity in excess of 2 020 MW or that it divests itself of all operational control and interest in that excess Restricted Capacity.
