À titre d'observation générale, la Commission rappelle que la directive doit être interprétée et appliquée conformément aux droits fondamentaux[5], notamment le droit au respect de la vie privée et familiale, le principe de non-discrimination, les droits de l'enfant et le droit à un recours effectif, tels qu'ils sont garantis dans la convention européenne des droits de l'homme (CEDH) et repris dans la charte des droits fondamentaux de l'UE.
As a general remark, the Commission recalls that the Directive must be interpreted and applied in accordance with fundamental rights[5], in particular the right to respect for private and family life, the principle of non-discrimination, the rights of the child and the right to an effective remedy as guaranteed in the European Convention of Human Rights (ECHR) and as reflected in the EU Charter of Fundamental Rights.

Family life is protected by Art. 8 of the ECHR and by Art. 7 of the Charter of Fundamental Rights; it should also be recalled that the rights of the child deserve special consideration, in accordance with Art. 24 of the Charter of Fundamental Rights and the Convention for the Right of the Child of 1989; in all actions related to children, the child's best interest must be a primary consideration.
