Depuis 2007, un certain nombre de parlementaires, dont un ancien Premier ministre, ont ainsi été dispensés d'enquête pénale par le refus du Parlement d'autoriser l'ouverture de telles enquêtes à leur encontre[47]. Le fait que le Parlement ne motive pas ses refus d'autoriser l'ouverture d'enquêtes pénales rend difficile l'établissement de l'objectivité des décisions[48]. En outre, le fait que des parlementaires puissent continuer à siéger tout en étant condamnés pour des infractions graves de type corruption entache la réputation du Parlement. Dans nombre de systèmes parlementaires, il est de pratique courante de suspendre les parlementaires mis en accusation dans de telles affaires et de les exclure dès lors qu'ils sont condamnés[49].

Par le premier moyen de pourvoi, concernant le secteur de l’huile d’olive, la République hellénique soutient que l’arrêt attaqué est entaché d’erreurs de droit, en ce que le Tribunal a procédé à une interprétation et application erronées des orientations contenues dans les documents AGRI/VI/5330/1997, AGRI/17933/2000 et AGRI/61495/2002, tels qu’en vigueur, puisqu’il a considéré l’amélioration incontestable du système de contrôle dans le secteur de l’huile d’olive pour la période 2004 — 2005 par rapport à la période 2003 — 2004, comme étant une récidive, une faiblesse récurrente et une dégradation sensible justifiant une majoration de la correction pour la période 2004 — 2005, alors qu’il n’y avait manifestement pas lieu de majorer la correction de 10 %, imposée pour la période 2003 — 2004, à 15 %, pour la période 2004 — 2005, pour cause de récidive, au vu des innombrables améliorations (actualisation constante du SIG oléicole, amélioration des contrôles sur place et croisés qui donnent lieu à des constatations d’infractions et à l’imposition de sanctions) qui ont immunisé le système de contrôle.
By the first ground of appeal, in the sector of olive oil production, the Hellenic Republic submits that the judgment under appeal manifestly erred in law by reason of the misinterpretation and misapplication of the guidelines contained in the documents AGRI/VI/5330/1997, AGRI/17933/2000 and AGRI/61495/2002, then in force, since it regarded the manifest improvement of the control system in the sector of olive oil production in the 2004-2005 period, as compared with the 2003-2004 period, as repeat offending, continuing weaknesses and marked deterioration justifying an increased correction for the 2004/2005 period, although it was clearly inappropriate to increase the correction from the 10 % which was imposed for the 2003/2004 period to 15 % for the 2004/2005 period on the ground of repeat offending, given that there were numerous improvements (further updating of the Olive cultivation-GIS, improved on-the-spot checks and cross-checks which detect irregularities and impose penalties) which reinforced their control system.
