Sans un solide fondement scientifique pour conclure que la consommation de cannabis est nettement préjudiciable pour un nombre important de consommateurs et(ou) la société en général, et que ce préjudice menace le Dominion dans son ensemble, Nous soutenons que le contrôle ou la réglementation du cannabis doit se caractériser comme un sujet de préoccupation provincial, soit comme une affaire de propriété et de droits civils (a.92(13)) ou comme une affaire de nature locale ou privée (a.92(16)), comme la réglementation sur la consommation de l’alcool.
Without a sound scientific basis for concluding that the consumption of cannabis is seriously harmful to a significant number of consumers and/or to society at large, and that this harm threatens the Dominion as a whole, it is submitted that the control or regulation of cannabis must be characterized as a provincial concern, either as a matter of property and civil rights (s.92(13)) or as a matter that is of a local or private nature (s.92(16)), such as the regulation of alcohol consumption.
