Définition: Le patient attribue ses symptômes au trouble somatique d'un système ou d'un organe innervé et contrôlé, en grande partie ou entièrement, par le système neurovégétatif: système cardio-vasculaire, gastro-intestinal, respiratoire, et urogénital. Definition: Symptoms are presented by the patient as if they were due to a physical disorder of a system or organ that is largely or completely under autonomic innervation and control, i.e. the cardiovascular, gastrointestinal, respiratory and urogenital systems. In the light of the case-law cited in paragraphs 43 to 45 above, the Tribunal considers that, in view of the obligations incumbent on a selection board, the decision not to include a candidate on a reserve list must be annulled if it transpires that the competition was organised in a way which led to a risk of inequality that was greater than that inherent in any competition, without the candidate concerned’s being required to provide evidence of the fact that some candidates were actually at an advantage.

Calls on the Council to respect fully all elements of the framework for negotiations as laid down in the conclusions of the meeting of the European Council of 17 December 2004; emphasises in particular in this framework that the shared objective of the negotiations is accession, that these negotiations are an open-ended process, the outcome of which cannot be guaranteed in advance, and that, while taking account of all Copenhagen criteria, if the candidate State is not in a position to assume in full all the obligations of membership, it must be ensured that the candidate State concerned is fully anchored in the European structures through the strongest possible bond;

Stresses the importance of absorption capacity as ultimately the decisive criterion for the successful adoption of the Community acquis in the area of structural policy; encourages the applicant countries to set about preparations for implementing investment in infrastructure in the areas of transport and the environment as quickly as possible and calls on them to improve their own administrative capacities to reduce the risks of low uptake of those resources, in order to ensure a smooth phasing-in process in the area of the structural and cohesion funds; takes the view that it is essential that the candidate countries concerned adopt the necessary political and legal instruments to achieve a regionalisation which meets the requirements arising in particular from the management of Structural Funds;
