Advenant que l'on amende la Constitution pour y inclure le droit à la propriété, comme le propose mon collègue réformiste, cela voudrait dire que l'ex-époux qui a acheté la maison pourrait contester la loi provinciale en plaidant la Charte canadienne, en disant tout simplement que c'est le droit de jouir de sa propriété qui est brimé.
In the event that the Constitution is amended to include the right to property, as is being proposed by my Reform colleague, that would mean that the ex-spouse who bought the house could contest the provincial legislation under the Canadian Charter simply by saying that his or her right to enjoyment of property is being interfered with.
