77.029 (1) The Governor in Council, on the recommendation of the Minister of Finance and the Minister, may, by order, at any time after the expiration of sixty days, but in no case later than ninety days, following an affirmative finding against a NAFTA country by a special committee requested by Canada under Article 1905.2 of the North American Free Trade Agreement, suspend the application to that NAFTA country of such benefits under the North American Free Trade Agreement as the Governor in Council considers appropriate in the circumstances.

2. The Commission may suspend the application of the import tariff quota referred to in Article 1 by means of implementing acts, in whole or in part, in the event that either the United States or Canada do not take the steps planned in the Memorandum of Understanding between the United States and the European Commission (4) or in the Memorandum of Understanding between the Government of Canada and the European Commission (5), respectively.

Through clause 9, the federal government gives itself the following powers: 9 (1) For the purpose of suspending benefits or imposing retaliatory measures of equivalent effect against a province pursuant to Article 1710 of the Agreement, the Governor in Council may, by order, do any one or more of the following: (a) suspend rights or privileges granted by the government of Canada to the province under the Agreement or any federal law; (b) modify or suspend the application of any federal law with respect to the province; (c) extend the application of any federal law to the province; and; (d) take any other measure that the Governor in Council considers necessary (2) In this section, ``federal law'' means the whole or any portion of any Act of Parliament or any regulation, order or other instrument issued, made or established in the exercise of a power conferred by or under an Act of Parliament.

In addition to a residual power to take any other measures necessary for that purpose, three specific measures are listed in paragraphs (1)(a) to (c): suspension of rights or privileges granted by Canada to Colombia or to Colombian goods under the Agreement or federal law; modification or suspension of federal law with respect to Colombia or to Colombian goods; and extension of the application of federal law to Colombia or to Colombian goods.
