“federal institutions” includes any of the following institutions of the Parliament or Government of Canada: (a) the Senate, (b) the House of Commons, (c) the Library of Parliament, (c.1) the office of the Senate Ethics Officer and the office of the Conflict of Interest and Ethics Commissioner, (d) any federal court, (e) any board, commission or council, or other body or office, established to perform a governmental functions by or pursuant to an Act of Parliament or by or under the authority of the Governor in Council, (f) a department of the Government of Canada, (g) a Crown corporation established by or pursuant to an Act of Parliament, and (h) any other body that is specified by an Act of Parliament to be an agent of Her Majesty in right of Canada or to be subject to the direction of the Governor in Council or a minister of the Crown, but does not include (i) any institution of the Council or government of the Northwest Territories or of the Legislative Assembly or government of Yukon or Nunavut, or (j) any Indian band, band council or other body established to perform a governmental function in relation to an Indian band or other group of aboriginal people [.]

The Committee’s examination began on March 20, 2007, when the Honourable Vic Toews, the President of the Treasury Board of Canada appeared before the Senate Committee to testify on the 2007-2008 Estimates. He was accompanied by two officials from the Treasury Board Secretariat of Canada: David Moloney, Senior Assistant Secretary, Expenditure Management Sector; and Laura Danagher, Executive Director, Expenditure Operations and Estimates Directorate, Expenditure Management Sector.

Toutefois, la Chambre des communes, en désaccord avec le Sénat, a déclaré dans son message du 21 novembre 2006 envoyé à celui-ci que cet amendement était « [inacceptable] car [il maintiendrait] le poste distinct de conseiller sénatorial en éthique, ce qui est contraire à l’objectif d’un commissaire commun aux conflits d’intérêts et à l’éthique qui pourrait apporter un point de vue général sur les questions concernant les conflits d’intérêts et l’éthique »(8). Le Sénat a néanmoins insisté sur les amendements portant sur le conseiller sénatorial en éthique et a fait savoir à la Chambre des communes que « ces amendements [.] sont très importants pour le statut et les privilèges du Sénat du Canada à titre de chambre du Parlement distincte et indépendante, au sens de la Constitution, et reflètent les façons de faire d’autres démocraties parlementaires selon le modèle de Westminster »(9). La Chambre des communes a finalement accepté les amendements du Sénat, et le projet de loi C-2 a reçu la sanction royale le 12 décembre 2006(10).
The House of Commons, however, disagreed with the Senate, and in its 21 November 2006 message to the Senate, stated that this amendment was “unacceptable because [it] would continue the separate existence of the Senate Ethics Officer contrary to the goal of a unified Conflict of Interest and Ethics Commissioner who could bring a broad perspective to bear on conflict of interest and ethical matters” (8) The Senate nonetheless insisted on the amendments pertaining to the Senate Ethics Officer and communicated to the House of Commons that “these amendments . are of significant importance to the status and privileges of the Senate of Canada as a constitutionally separate and independent House of Parliament, and reflect the practice of other Westminster based parliamentary democracies” (9) The House of Commons finally concurred with the Senate amendments, and Bill C-2 received Royal Assent on 12 December 2006 (10)
