By the second plea, it is alleged that the addition of a specific correction in the amount of EUR 1 91 873,55 to the general flat-rate correction of 2 %, and the method of calculation, are contrary to Article 31(2) of the Regulation No 1290/2005 and to the Commission documents on the guidelines for the calculation of financial corrections, because it is not appropriate to use two methods of calculation at the same time for the same infringement.

Notes that the Commission reports the errors in the Land Parcel Identification System (LPIS) in France and Portugal since 2006; notes that before 2010 no own initiative action plan had been initiated in these countries; criticises the fact that ‘action plans’ instigated by the Commission have only started in 2010 for Portugal and as late as in 2013 for France; considers that, although the way in which the Commission addresses the deficiencies detected in the LPIS systems in order to calculate the financial corrections gives rise to lengthy conformity procedures, delays in the adoption of action plans and reservations in the annual activity reports it makes for real financial corrections, as called for by Parliament and the Court of Auditors, rather than flat-rate corrections which are open to challenge by the Member States and recipients; supports the Commission in its approach, and calls for the systems to be improved in any way possible, including the provision of training to staff, in order to enhance their effectiveness and rapidity;

For the purposes of calculating volatility adjustments where such financial instruments or commodities which are not eligible under Annex VIII of Directive 2006/48/EC are lent, sold or provided, or borrowed, purchased or received by way of collateral or otherwise under such a transaction, and the institution is using the Supervisory volatility adjustments approach under Part 3 of Annex VIII to that Directive, such instruments and commodities shall be treated in the same way as non‐main index equities listed on a recognised exchange.

As regards attempts to reach a compromise, the Commission would point out, as it has already stated in its reply to Special Report No 22/00 of the Court of Auditors, that it is legally obliged to exclude expenditure from Community financing where that expenditure has not been effected in compliance with Community rules and therefore cannot accept compromises that would not be compatible with this obligation.
