La Confédération suisse assume tous les coûts liés à sa participation à l'opération, à moins que les coûts ne fassent l'objet d'un financement commun prévu par les instruments juridiques visés au point 1 des présentes modalités, ainsi que par la décision 2004/197/PESC du Conseil du 23 février 2004 créant un mécanisme de gestion du financement des coûts communs des opérations de l'UE ayant des implications militaires ou dans le domaine de la défense (3).
The Swiss Confederation shall assume all the costs associated with its participation in the operation unless the costs are subject to common funding as provided for in the legal instruments referred to in paragraph 1 of these arrangements, as well as in Council Decision 2004/197/CFSP of 23 February 2004 establishing a mechanism to administer the financing of the common costs of EU operations having military or defence implications (3).

Sans préjudice du caractère civil de la mission, les États membres contributeurs visés à l'annexe peuvent, aux fins de la présente action commune, en vue de l'appel des contributions, de la collecte des fonds correspondants, de leur gestion, de leur utilisation et contrôle et des arrangements administratifs requis, avoir recours notamment aux personnels du mécanisme établi par la décision 2004/197/PESC du Conseil (2), à titre exceptionnel, jusqu'au 15 février 2006 et eu égard au fait que le projet sera financé conformément au paragraphe 2 à partir du 16 février 2006.
Without prejudice to the civilian nature of the mission, the contributing Member States listed in the Annex may, for the purposes of this Joint Action, with a view to the call for contributions and the collection, management, use and monitoring of the corresponding funds and the requisite administrative arrangements, make use in particular of the staff of the mechanism set up by Decision 2004/197/CFSP (2), by way of exception, until 15 February 2006 and from 16 February 2006 having regard to the fact that the project will be financed in accordance with paragraph 2.

In accordance with Article 28(3) of the Treaty on European Union, the operational expenditure arising from this Joint Action, having military or defence implications, should be charged to the Member States in accordance with Council Decision 2004/197/CFSP of 23 February 2004 establishing a mechanism to administer the financing of the common costs of European Union operations having military or defence implications (3) (hereafter referred to as ‘ATHENA’).
