4. 4. L'article 1 est adopté. Article 2, Brian Pallister propose, Que le projet de loi C-35, à l'article 2, soit modifié par adjonction après la ligne 20, page 1, de ce qui suit : « 2 (1) L'alinéa 4(1)a) de la même loi est remplacé par ce qui suit : a) sous réserve du paragraphe (1.1), étendre les privilèges ou immunités dont ils bénéficient en vertu de l'article 3, à l'exception des privilèges d'exonération fiscale ou douanière; (2) L'article 4 de la même loi est modifié par adjonction, après le paragraphe (1), de ce qui suit : (1.1) Le ministre des Affaires étrangères ne peut étendre l'immunité de la juridiction pénale à une personne qui ne bénéficie pas d'une telle immunité aux termes de la Convention de Vienne sur les relations diplomatiques, à moins que Sa Majesté du chef du Canada n'ait conclu un accord qui l'oblige à agir ainsi».
On Clause 2, Brian Pallister moved, That Bill C-35, in Clause 2, be amended by adding after line 20 on page 1 the following: " 2 (1) Paragraph 4(1)(a) of the Act is replaced by the following: (a) subject to subsection (1.1), extend any of the privileges and immunities accorded thereto under section 3, other than duty and tax relief privileges; (2) Section 4 of the Act is amended by adding the following after subsection (1): (1.1) The Minister of Foreign Affairs shall not extend immunity from criminal jurisdiction to any person whom the Vienna Convention on Diplomatic Relations does not identify as enjoying immunity from criminal jurisdiction unless Her Majesty in right of Canada has entered into an agreement that obliges the Minister to extend such immunity to that person" .

The Court holds that, where the court second seised is the court of the Member State in which the property is situated and thus has exclusive jurisdiction, it is not required either to stay its proceedings or to decline jurisdiction in favour of the court first seised, but must give a ruling on the substance of the action before it.

For the purposes of points 3.1, 3.2 and 3.3 an item of income should be considered to be subject to tax where it is treated as taxable by the jurisdiction concerned and is not exempt from tax, nor benefits from a full tax credit or zero-rate taxation.
