If the budget has not been finally adopted at the latest two weeks before the entry for January of the following financial year, the Member States shall enter on the first working day of each month, including January, one-twelfth of the amount of the VAT-based own resource, and the GNI-based own resource, taking into account the effect on these resources of the correction granted to the United Kingdom for budgetary imbalances and of the gross reduction granted to Denmark, the Netherlands, Austria and Sweden, entered in the last budget finally adopted; the adjustment shall be made on the first due date following final adoption of the budget if it is adopted before the sixteenth of the month.

Points out that the 2011 budget is the fourth of seven under the current MFF, and emphasises that point 37 of the IIA on the use of the 5% margin of legislative flexibility now makes full sense, since the two arms of the budgetary authority have a clearer view of the shortfalls of, and positive developments in, existing programmes; recalls that, irrespective of the provisions of the IIA, ensuring an appropriate level of flexibility in the EU budget is a prerequisite for its effective implementation in a useful manner; expects the Council MFF regulation to be adopted on the basis of COM(2010)0072 final and the forthcoming IIA to be adopted on the basis of COM(2010)0073 final, to allow for greater flexibility;

5. Where a decision is to be adopted by the Council acting by qualified majority, 65 % of the population of the Union or, where not all Member States participate in voting, of the population of the participating Member States, and the minimum number of Council members representing more than 35 % of the population of the participating Member States shall be calculated in accordance with the population figures set out in Annex III. These figures shall also apply between 1 November 2014 and 31 March 2017 where, in accordance with Article 3(2) of Protocol No 36 on transitional measures, annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community, a member of the Council requests that an act be adopted in accordance with the qualified majority as defined in paragraph 3 of that Article and a member of the Council requests that it be verified that the Member States comprising the qualified majority represent at least 62 % of the total population of the Union.
