La gestion partagée, définie à l'article 53 du règlement financier [5], est un des modes à travers lesquelles la Commission exerce la tâche d'exécution du budget communautaire. Cette tâche lui incombe en vertu de l'article 274 du traité : « la Commission exécute le budget[...] sous sa propre responsabilité et dans la limite des crédits alloués, conformément au principe de la bonne gestion financière.
Shared management, as defined in Article 53 of the Financial Regulation [5], is one of the ways in which the Commission implements the Community budget, a task laid on it by Article 274 of the Treaty: "The Commission shall implement the budget [...] on its own responsibility and within the limits of the appropriations, having regard to the principles of sound financial management.

On 5 October 2006 the Court upheld the Commission's position when it ruled that certain Member States were wrong to refuse to pay certain categories of resources into the Community budget, in this case instalments of traditional own resources recovered under a payment plan [14] and guaranteed and uncontested duties resulting from undischarged transit operations conducted in the form of Community transit [15] or under a TIR carnet.

Il convient également de noter que le 5 octobre 2006, la Cour a confirmé la position de la Commission et considéré que c'était à tort que certains Etats membres refusaient de verser au budget communautaire certaines catégories de montants, à savoir les montants de RPT recouvrés partiellement dans le cadre d'un plan de paiement échelonné (Belgique[14]) et des montants de droits garantis et non contestés dans le cadre d'opérations de transit non apurées effectuées en tant que transits communautaires (Belgique[15]) ou sous couvert de carnets TIR (Allemagne[16] et Belgique[17]). Elle s'attachera notamment à déterminer s'il convient de renforcer les incitants financiers sous la forme de prêts à faible taux d'intérêt et/ou d'aides non remboursables, de quelle manière le budget communautaire pourrait être utilisé à cette fin et, le cas échéant, si la Commission inclura, entre autres, des fonds supplémentaires pour le financement de l'efficacité énergétique dans le nouvel instrument européen pour la sécurité et les infrastructures énergétiques qui doit être présenté en 2010.

In order to avoid these risks, it is necessary to establish a mechanism for the collection and disposal of by-products that guarantees the quality of the wine through control on compliance with the ban, that does not entail additional costs for wine producers, that does not impact excessively on the Community budget for the CMO in wine, that ensures respect for the environment, in compliance with primary and secondary Community law, and that also allows the by-products of wine-making to the used for the production, inter alia, of renewable alternative energies.
