La gestion partagée, définie à l'article 53 du règlement financier [5], est un des modes à travers lesquelles la Commission exerce la tâche d'exécution du budget communautaire. Cette tâche lui incombe en vertu de l'article 274 du traité : « la Commission exécute le budget[...] sous sa propre responsabilité et dans la limite des crédits alloués, conformément au principe de la bonne gestion financière.
Shared management, as defined in Article 53 of the Financial Regulation [5], is one of the ways in which the Commission implements the Community budget, a task laid on it by Article 274 of the Treaty: "The Commission shall implement the budget [...] on its own responsibility and within the limits of the appropriations, having regard to the principles of sound financial management.

(2) In order to guarantee a certain degree of consistency in these rules compared with Regulation (EC, Euratom) No 1605/2002 (hereinafter "the general Financial Regulation") and pursuant to Article 185(1) of that Regulation, this framework Financial Regulation must lay down the rules governing the establishment, implementation and scrutiny of the budget of the said Community bodies which actually receive grants charged to the Community budget (hereinafter "Community bodies").

(5) considérant que la responsabilité du contrôle des dépenses du Fonds, section "garantie", incombe, en premier lieu, aux États membres, qui désignent les services et organismes habilités à payer les dépenses; que les États membres doivent assumer pleinement et effectivement cette responsabilité; que la Commission, responsable de l'exécution du budget communautaire, doit vérifier les conditions dans lesquelles les paiements et les contrôles ont été effectués; que la Commission ne peut financer les dépenses que lorsque ces conditions offrent toutes les assurances nécessaires quant à la conformité aux règles communautaires; que, dans le cadre d'un système décentralisé de gestion des dépenses communautaires, il est essentiel que la Commission, en sa qualité d'institution chargée du financement, ait le droit et les moyens d'effectuer toutes les vérifications relatives à la gestion des dépenses qu'elle juge nécessaires, et que la transparence et l'assistance mutuelle entre les États membres et la Commission soient effectives et complètes;
(5) Whereas the responsibility for checking the Fund's Guarantee Section expenditure lies, in the first place, with the Member States, which designate the authorities and bodies empowered to effect expenditure; whereas the Member States must carry out this task fully and effectively; whereas the Commission, being responsible for implementing the Community budget, must verify the conditions under which payments and checks have been made; whereas the Commission can only finance expenditure where those conditions offer all necessary guarantees regarding compliance with Community rules; whereas, in a decentralised system of management of Community expenditure, it is essential that the Commission, as the institution responsible for funding, its entitled and enabled to carry out all checks on the management of expenditure it considers necessary and that there should be full and effective transparency and mutual assistance between the Member States and the Commission;
