À la suite des discussions à haut niveau qui se sont tenues avec les autorités tchèques, une enveloppe de 24 millions d'euros prélevée sur le budget 2002 (auxquels s'ajoute un montant de 6 millions d'euros prélevé sur le budget 2003) a été allouée, au titre de l'ISPA, à des projets de reconstruction dans le secteur des transports et de l'environnement. Ce soutien fait partie de la réaction globale de la Commission à l'état d'urgence.
Following high-level discussions with the Czech authorities, EUR 24 million ISPA support from the 2002 budget (plus EUR 6 million from 2003) were allocated to reconstruction measures in transport and environment, as part of the Commission's overall response to the emergency.

In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (1) and the Financial Regulation adopted by the Management Board of the Agency on 26 March 2003, with Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (2) and with the other instruments referred to in this Decision, contracts or agreements concluded and decisions taken with beneficiaries established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the beneficiaries and of their subcontractors by Agency and Commission officials or by other persons mandated by the Agency and the Commission.

Stresses the impossibility of financing all needs in the context of external policies due to the constraints of heading 4, thus jeopardising the credibility of the EU throughout the world; deplores, in particular, the reductions made on budget 2002 for a number of important programmes and budget articles including the MEDA programme for which the commitments will be reduced by 25% compared to the 2000 financial year; urges the Council and the Commission to take it into consideration when proposing new policies and to cooperate in solving the structural problem of the ceiling of heading 4 in the short and medium-term;

Notes that as long as the annual ceilings for external relations expenditure fixed in the financial perspective are left unchanged, the new financing needs resulting from new responsibilities can only be met through measures such as mobilisation of the flexibility instrument and ear-marking of amounts in reserves, in combination with savings based on the implementation of the 2002 and earlier budgets and on identified significant reductions in the need for EU action, if any; is concerned that this may still prove insufficient;

L’article 164 du règlement (CE, Euratom) no 2342/2002 de la Commission du 23 décembre 2002 établissant les modalités d'exécution du règlement (CE, Euratom) no 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes (3) («modalités d’exécution») prévoit que lorsque la mise en œuvre d’une action susceptible de bénéficier d’une subvention communautaire nécessite la passation de marchés, la convention de subvention conclue à cet effet doit inclure les règles de passation des marchés auxquelles le bénéficiaire doit se conformer.
Article 164 of Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (3) (the implementing rules), provides that where the implementation of an action for which a Community grant may be received involves procurement, the grant agreement concluded for that purpose should include the procurement rules with which the beneficiary must comply.
