Le gouvernement wallon a de plus décidé en juin 2003 que les sommes dues par BSCA au fonds, soit environ 2,8 millions d'euros, seront versées à la Sowaer sous déduction de 250000 euros de frais de gestion dudit fonds.
The Walloon Government, moreover, decided in June 2003 that the sums which BSCA had to pay into the Fund, i.e. about EUR 2,8 million, would be paid to Sowaer, after deducting EUR 250000 in costs for managing the Fund.

Au contraire, la Commission considère en l'espèce que la Région wallonne a eu la faculté permanente, et en a usé à plusieurs reprises, de définir, d'utiliser et de répartir le produit des redevances aéroportuaires de manière discrétionnaire entre plusieurs intervenants tels que BSCA, le fonds environnement, la Sowaer, voire Ryanair, et d'influer de manière directe sur leurs conditions d'exploitation.
On the contrary, the Commission considers in the case at issue that the Walloon Region had a permanent option, which it used on several occasions, of defining, using and allocating the revenue from airport fees in a discretionary way between several participants such as BSCA, the environment fund and even Ryanair, and to exert a direct influence on their methods of operation.

En particulier, la part à reverser à un fonds environnement, fixée à 35 % des redevances encaissées, a été régulièrement modifiée par la Région wallonne quant à son plafonnement ou non, quant à son destinataire, c'est-à-dire un fonds dédié ou le nouvel actionnaire public de BSCA, la Sowaer, et enfin quant à la liquidation dudit fonds et à l'affectation des sommes lui étant dues par BSCA.
In particular, the portion payable to the environment fund, fixed at 35 % of the fees received, has been regularly altered by the Walloon Region in relation to whether or not it should be capped, in relation to its recipient (that is, a dedicated fund or the new BSCA public shareholder Sowaer), and finally in relation to the liquidation of the said fund and the allocation of the sums owed to it by BSCA.
