Definition: Symptoms are presented by the patient as if they were due to a physical disorder of a system or organ that is largely or completely under autonomic innervation and control, i.e. the cardiovascular, gastrointestinal, respiratory and urogenital systems. The symptoms are usually of two types, neither of which indicates a physical disorder of the organ or system concerned. First, there are complaints based upon objective signs of autonomic arousal, such as palpitations, sweating, flushing, tremor, and expression of fear and distress about the possibility of a physical disorder. This Regulation shall not affect agreements by which Member States undertook, prior to the entry into force of Regulation (EC) No 44/2001, pursuant to Article 59 of the Brussels Convention on jurisdiction and the enforcement of judgments in civil and commercial matters, not to recognise judgments given, in particular in other Contracting States to that Convention, against defendants domiciled or habitually resident in a third country where, in cases provided for in Article 4 of that Convention, the judgment could only be founded on a ground of jurisdiction specified in the second paragraph of Article 3 of that Convention.

Whereas decisions regarding the validity and infringement of Community trade marks must have effect and cover the entire area of the Community, as this is the only way of preventing inconsistent decisions on the part of the courts and the Office and of ensuring that the unitary character of Community trade marks is not undermined; whereas the rules contained in the Brussels Convention of Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters will apply to all actions at law relating to Community trade marks, save where this Regulation derogates from those rules;

CONSIDÉRANT que le royaume d'Espagne et la République portugaise, en devenant membres de la Communauté, se sont engagés à adhérer à la convention de Bruxelles concernant la compétence judiciaire et l'exécution des décisions en matière civile et commerciale et au protocole concernant l'interprétation de cette convention par la Cour de justice, avec les adaptations y apportées par la convention relative à l'adhésion du royaume de Danemark, de l'Irlande et du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord et les adaptations y apportées par la convention relative à l'adhésion de la République hellénique, et à entamer à cet effet des négociations avec les États membres de la Communauté pour y apporter les adaptations nécessaires;
CONSIDERING that the Kingdom of Spain and the Portuguese Republic, in becoming members of the Community, undertook to accede to the Convention on jurisdiction and the enforcement of judgments in civil and commercial matters and to the Protocol on its interpretation by the Court of Justice, with the adjustments made to them by the Convention on the accession of the Kingdom of Denmark, of Ireland and of the United Kingdom of Great Britain and Northern Ireland and the adjustments made to them by the Convention on the accession of the Hellenic Republic, and to this end undertook to enter into negotiations with the Member States of the Community in order to make the necessary adjustments thereto,
